This is exactly the kind of thing I'd love to see volunteer leadership step up and address. I could spend a lot of my time responding to every single one of these articles and replying with op eds or LTE's, but that would take probably all my time and it would not be anywhere near as impactful as other Texas "non-environmental-professionals" responding. This is why I'd like the next meeting in Fayette to be dedicated to LTE writing and outreach to media and elected officials. I am, of course, all about helping and even writing some of these myself, but we need the involvement of the farmers and other locals themselves and their willingness to submit these letters.

I think it would be great if you would start it off and write one yourself John. Showing others how simple and easy (relative to their probable expectations) it is would go a long way to helping. I am happy to help edit it and/or find the relevant info for you, but from this email it already sounds like you've got a pretty great grasp of what's needed in response already. The important thing is to start getting the counter-messaging out there.

In my opinion, the May 12, 2012 City and State Section, pages B4 and B9, respectively, of the Houston Chronicle has an article and an opinion that must be publicly and aggressively countered by your group and other groups like The Sierra Club and Greenpeace:
 
1.  An article by Chronicle reporter, Matthew Tresaugue, that reports a quote by U.S. Senator Kay Bailey Hutchinson that making Matagorda County subject to tighter emission controls "could be a significant blow to the economy" and a quote by Matagorda County Judge McDonald that the EPA decision to not subject Matagorda County to tighter emission controls makes it a "happy day".  There is no mention of the cost to the Matagorda agricultural and recreational economy and its people in terms of increased health care costs, poisoning of wetlands and bays, and loss of irrigation water as a result of the Judge's "happy day".
 
2.  The opinion by Lance Brown of the Partnership for Affordable Clean Energy (which the Chronicle gratuitously describes as "a coalition that is working for fair, responsible energy policies") entitled "Time for the EPA to stop putting politics before the facts" that quotes Governor Perry as describing the Cross-State Air Polution Rule" as a "highly flawed, job-killing rule that was based on inaccurate and incomplete information" and quotes Sen. John Cornyn as stating that "The EPA has systematically targeted Texas through burdensome regulatory overreach, putting politics ahead of facts and due process.  Now we know they intend to crucify energy producers in our state". 
 
Neither Perry nor Cornyn no Hutchinson mention the $2 billion per year Texas pays out of state coals or the billions of dollars in health care costs caused by coal or the water wasted by coal or the millions of lasting jobs and cleaner air and increased tax revenue and the energy independence and increased national security that Texas natural gas fired power plants and cars and trucks for that matter would create in lieu of coal or the exporting of electricity to other states that long term cost effective West Texas wind farms would produce.  Cornyn and Hutchinson both fail to disclose that they recently voted against an amendment to the highway bill supporting the NAT Gas Act (part of the "Pickens Plan").
 
In my opinion, environmental groups like the No Coal Coalition must publicly address each and every one of these local and state and federal representatives with the facts.  It is time for us to demand that national environmental groups that have the resources to fight back with the facts like The Sierra Club and Greenpeace start providing and publicizing the data in a format that counters the likes of Hutchinson, McDonald, Perry, and Cornyn who, in my opinion, are using "Swift Boat" like tactics for the benefit of the likes of out of state coal and nuclear interests.
 
I am copying representatives of The Sierra Club and Greenpeace with this email in hopes that they will forward this demand to their chief executives and boards of directors and not allow these "Swift Boat" like tactics to destroy recent progress by the EPA in stopping the use of coal in Texas.  Unfortunately, the opinion by Lance Brown indicates that the EPA is beginning to crater and even cater to coal interests in Texas making the need to counter these "Swift Boat" tactics even more urgent and serious.

Two weeks ago, we submitted more than 68,000 of your comments to the USDA in opposition to its proposal to privatize poultry inspection. Now the USDA is wobbling a bit, extending the public comment period on the proposal for an additional 30 days.

To crank up the pressure, with the help of some allies we just created a petition on whitehouse.gov asking the Obama administration to rescind the USDA's proposal. When we get 25,000 signatures on this petition, the White House will issue an official response.

It's hard to imagine the Obama administration coming out in favor of weakening food safety standards during an election year. As such, once we get 25,000 signatures, it's likely they will stop the privatization of poultry inspection from ever happening.

Dear James,
Gumaro Martinez is 13 years old and has asthma. Like millions of other Latinos, he lives near power plants that spew out toxic chemicals and dangerous carbon pollution almost constantly.1 Two out of five Latinos live near a toxic power plant.2  Now it's time for us to stand up for the health of our children and communities. 
With your help, Gumaro and many Latino children have an opportunity to breath more freely. 
The Environmental Protection Agency (EPA) just proposed a new rule that will limit industrial carbon pollution coming from new power plants.3
This is a great first step.  The EPA needs to adopt this critical rule and propose new rules to cover existing power plants that have made it impossible for Gumaro and tens of thousands of Latino children sick with asthma and other respiratory problems from living a full, healthy life.
We have a limited time to influence their decision.
The EPA has opened a public comment period that's closing soon and we need you to tell the EPA that we support strong protections for industrial carbon pollution for new and existing power plants.
While this announcement is important, it’s only the first step to protect kids like Gumaro.
In addition to helping Latino children, limiting carbon pollution from power plants will also reduce greenhouse gases that cause both climate change and the smog that triggers asthma attacks and other respiratory problems for people across our communities. 
The Southwest, where the overwhelming majority of Latinos live, is what the New York Times calls “first climate change victim” as record-breaking fires, ongoing and worsening droughts and other climate-related impacts make life there even more difficult.4
As the earth's temperature rises, it’s literally destroying the farming livelihoods of millions in Central America and Mexico, forcing them to leave their homes and emigrate to the United States and other countries to look for work.5 The same pollution that is destroying the lungs of Latino children like Gumaro are raising temperatures and destroying livelihoods in Latin America.
It has taken years for the EPA to propose these safeguards that can improve our lungs and our climate. Now we must seize this moment to push them further and extend these standards to existing power plants.

Wonder if the tugs were deployed from the onset off tankers power loss?  I hope there was not a protocol or situation scenario forecast fallout.  It was reported that the tanker was on bearing to the Port of Corpus Christi.  I think it makes sense to consider the proximity of the tanker-to-rig at onset of power loss and the time between power-loss and collision. I am curious about the time between power-loss, the radio transmission of it and the deployment of tugs along with the level of criticalness given to the situation.  Just a thought..simple stuff right? I am sure it will all be fully disclosed and addressed publicly as it should be and not tucked under for the surfacing of the doings of some reality TV or sports stars endeavors.

Aransas Pass is the major waterway for ocean-going traffic going into and out of the port of Corpus Christi.

Authorities deployed teams of offshore vessel inspectors, port state control examiners, marine casualty investigators and pollution responders.

I recall meeting and speaking with him at a public forum meeting here in CC just after his appointment.  He seems so genuine and sincere.  It seems as though he always stuck to his word and worked to do the right thing.  I hope he continues to serve in another capacity...

Armendariz, who oversaw Texas and four neighboring states, submitted his resignation Sunday after ill-advised comments he made two years ago surfaced last week in a video. Armendariz, trying to assuage residents of the tiny North Texas town of Dish who feared ill effects from drilling, told them the EPA would make examples of bad actors. It was the best that his outnumbered agency could do.

He likened the strategy to the Roman method of subduing an unruly village by crucifying a few of the inhabitants. Admittedly a poor choice of words, not meant to be taken literally.

Predictably, his detractors took those words as severely out of context as possible. They portrayed his speech as proof of a job-killing, anti-industry conspiracy. They couldn't have written him a better script to serve their purposes.

Just as predictably, he resigned, saying he "had become too much of a distraction."

Actually, he was pretty much a distraction from the get-go. According to the Dallas Observer, "Before SMU prof Al Armendariz had even warmed the seat at his post as EPA regional chief, he was pilloried as an activist whose research into the air pollution caused by fracking operations made him unfit to run a five-state office overseeing some of the industry's most important drilling grounds."

The pillorying didn't stop on his way out the door. Sen. James Inhofe, who released the video last week as his version of proof of an EPA assault on the energy industry, issued this statement Monday:

"We will continue our investigation into the situations surrounding EPA's apparent crucifixion victims: the American people deserve to know why, in at least three separate cases, EPA tarnished the reputation of companies by accusing them of water contamination; then when the results of their study did not turn out the way they hoped, and they had no definitive evidence to make that link, they quietly walked back their accusations. We will get to the bottom of this ... ."

Since 1989, the Innocence project has exonerated 289 wrongly convicted people who averaged 13.5 years in prison. Since 2009, Inhofe can cite three companies who suffered the indignity of waiting for the water tests to come back.

Imagine if Inhofe, other politicians and those industry "crucifixion victims" devoted the ample resources at their disposal to righting real miscarriages of justice such as those suffered by the innocently convicted, instead of trying to squelch environmental enforcement. In Texas alone, Gov. Rick Perry and Attorney General Greg Abbott have used state government resources to sue the EPA and to issue incendiary news releases against it.

It's unfortunate that Armendariz will be remembered for his "crucify" statemen t. He should be remembered first and foremost as a listener. He did a lot of that during his visits to Corpus Christi. He listened tirelessly to industry advocates and detractors.

While his critics feared the reaches of his agency, he knew it to be limited. Only operators of the older, dirtier coal-fired power plants needed to worry under his watch.

If he was the enemy of fracking and of prosperity that his critics have portrayed, then the EPA doesn't make Legionnaires like the Romans did. No one who has visited drilling sites in the Eagle Ford Shale would guess that fracking was under siege.

Not like Al Armendariz was under siege.

Jobless Claims Continue To Drop. The number of new applications for unemployment benefits dropped by 27,000 last week, brining them to their lowest level in a month.
BP Spill Settlement Advances. A federal Judge Wednesday gave preliminary approval to the class-action settlement that could result in BP paying $7.8 million for the 100,000 claims filed by those hurt by the Gulf Oil Spill. As part of the settlement, BP agreed to pay $2.3 billion for sea-food related claims from those in the commercial fishing industry, the medical expenses from cleanup workers and others and $105 million to set up a Gulf Coast health outreach program.
Gearing Up in Michigan.  Efforts to get collective bargaining rights in Michigan’s constitution are picking up with the Protect Our Jobs campaign hiring a Chief Strategist. Representatives of the Michigan Campaign Finance Network stated they believe the total cost of the question, from both sides, could top $10 million.
National and International Blue-Green
A new study, reported by Reuters, found plants are flowering 8.5 times faster in response to climate change than previously predicted.
CleanTechnica.com says Kenya and Peru have both passed climate change legislation.
The Epoch Times reports Munich is planning to generate all of its energy from renewable sources by 2020.
South Korea’s Parliament approved cap-and-trade legislation Wednesday, according to the Wall Street Journal.
According to the Brisbane Times, Australia is “likely to overshoot” its goal of receiving 20 percent of its energy from renewable sources by 2020.
Scientists in Australia are looking into how farmers are adapting to the affects of climate change, ABC North Queensland reports.
Bloomberg BNA says the European Union is expected to take action in response to concerns about endocrine disruptors and nanosubstances.
Fact.Check.org — a project of the Annenberg Public Policy Center — says Americans for Prosperity’s “Wasteful Spending” ad “distorts the truth about stimulus money for â€green jobs’ going overseas” and “introduces some new wrinkles to this well-used line of attack.”

Corpus Christi City staff will return later this month to City Council with a proposal for a solution to the single-use plastic bag problem.  Our Skip the Plastic team is advocating for a fee on the bags to help motivate shoppers to bring reusable bags instead of taking disposable ones.  As Brownsville has shown, a fee can make a big difference in the number of plastic bags taken out of stores - they eliminated about 300,000 per day - and the number that end up on our sand dunes, trees and fences.  
 
A fee is a great tool because it's optional.  If someone doesn't want to pay it, they can bring their own bags or if it's a small purchase, go without a bag.  If they choose to pay the fee, it goes to a fund for trash cleanups, giveaways of reusable bags and education about everyone's role in reducing litter in general.  The end results are that people become more aware about preventing litter and our city, beaches and bays become cleaner for humans and wildlife.  
 
So, please, take a minute to sign our petition telling the City Council that you agree with the fee!  https://www.change.org/petitions/corpus-christi-plastic-bag-ordinance

Wonder if the tugs were deployed from the onset off tankers power loss?  I hope there was not a protocol or situation scenario forecast fallout.  It was reported that the tanker was on bearing to the Port of Corpus Christi.  I think it makes sense to consider the proximity of the tanker-to-rig at onset of power loss and the time between power-loss and collision. I am curious about the time between power-loss, the radio transmission of it and the deployment of tugs along with the level of criticalness given to the situation.  Just a thought..simple stuff right? I am sure it will all be fully disclosed and addressed publicly as it should be and not tucked under for the surfacing of the doings of some reality TV or sports stars endeavors.

HOUSTON (ICIS)--A fuel oil tanker grounded offshore after colliding with an mobile drilling unit near Port Aransas on the Texas coast, the US Coast Guard said on Wednesday.

There were no reports of injuries or significant pollution, and the Aransas Pass Channel remains open to traffic, the Coast Guard said.

The collision occurred when the FR8 Pride lost power while heading inbound in the channel and drifted into the Rowan EXL-1, a mobile offshore drilling unit, the Coast Guard said.

Tugboats helped the tanker disengage itself from the rig, which suffered significant damage, the Coast Guard said.

Aransas Pass is the major waterway for ocean-going traffic going into and out of the port of Corpus Christi.

The tanker’s crew reported flooding in a forward ballast space, but they controlled it and were able to ground the vessel two miles (3.2km) offshore, the Coast Guard said.

Authorities deployed teams of offshore vessel inspectors, port state control examiners, marine casualty investigators and pollution responders.

The Coast Guard is investigating the collision.

Unemployment Down to 8.1 percent. America’s unemployment rate dropped to 8.1 percent last month thanks to the addition of 115,000 jobs. These new jobs included 130,000 private sector jobs which offset cuts by state and federal governments.
Looking To The States. People in several states are considering changes to their Renewable Energy Standards including in Michigan and Missouri where signatures are being collected to get a ballot question to increase the states’ RES requirements to 25 percent renewable energy by 2025.
Building a Skilled Workforce. The BlueGreen Alliance Foundation’s GreenPOWER program is taking steps to address the jobs skills gap being seeing in the manufacturing industry. The program has created a partnership with the Anoka Technical College and Anoka County Workforce Center to training current and unemployed workers in precision sheet metal and green manufacturing skills.
National and International Blue-Green
Manufacturing activity in Europe dropped last month at its fastest rate since October. Bloomberg Businessweek has more.
NASDAQ reports “U.S. Manufacturing and exports show signs of strength.”
National Geographic examines  how one possible affect of climate change —frequent flooding and droughts in Southeast Asia — could threaten “the world's rice bowl and millions of people who live there.”
Several U.S. and foreign automakers announced an agreement to standardize the charging system for electric vehicles. The Hill says the agreement is meant to “’harmonize’ the technology and speed up charging times.”
The civil trial for the Deepwater Horizon oil spill will begin January 14, 2013, the Times-Picayune reports.
In related news, the former BP engineer charged with deleted text messages related to the Deepwater Horizon Spill has pled not guilty to two counts of obstruction of justice, the Associated Press reports.
CNN says a company has introduced a line of “smog-eating tiles” that improve air quality by oxidizing smog-forming nitrogen oxides in the air.
To the States
The Baltimore Sun reports Maryland’s Governor signed several bills including a number of environmental measures.
According to the Associated Press, the Renewable Energy Transmission Authority and Power Network New Mexico has asked federal regulators for permission to build a 200-mile transmission line “to funnel solar- and wind-generated power to western markets.”

Dear Friend,
News broke Thursday that TransCanada has secretly submitted its permit application for the Southern portion of the Keystone XL Pipeline to the Army Corps of Engineers.1
The Army Corps, which has an abysmal environmental track record, could approve the project in 45 days - or sooner - unless the EPA steps in.
To evade meaningful review, TransCanada has has tried to break up the approval process, applying for an expedited permit for the Southern portion, which would allow the Army Corps to approve all 101 water crossings on the route between Cushing, Okla., and the Gulf Coast at once.
EPA has the power to stop this rubber stamp process, but it has to step in. We know that EPA officials have serious concerns about this expedited approval - and EPA's regional office said last fall the all-in-one permit was insufficient, given the serious threat to water and wetlands in Oklahoma and Texas.
Ultimately, all of this happens in the Obama administration, so President Obama is still the ultimate decision maker. And we know from his deeply unfortunate photo-op in TransCanada's pipe yard in Cushing, Okla., how much of an effort he is making to at least appear pro-pipeline.
But whether he and his EPA will allow 101 water crossings to be rubber stamped in one fell swoop is another matter. And we need to show strong support for the EPA officials who have already raised a red flag.
Meanwhile, TransCanada is also set to re-apply for the State Department for the northern portion of the pipeline as soon as today2 - the permit they were denied thanks to our activism this January.
By breaking up the pipeline TransCanada is trying to get a jump on construction, and circumvent the full approval process. But it doesn't change any of the facts on the ground. The southern route will still speed the exporting and burning of Tar Sands around the world - speeding catastrophic climate change.
The northern route will still enable Tar Sands producers to turn up the spigot on this dirty oil getting exported and burned overseas. And while TransCanada has revised the route through Nebraska, the new route still runs over the Ogallala Aquifer and runs through Nebraska's sensitive Sandhills region.
It's no surprise that we're receiving reports from Nebraska activists that the Koch Brothers are literally working with TransCanada to hoodwink Nebraskans into supporting this project, which will help the Kochs and oil companies from Saudi Arabia and Canada, while leaving us to deal with the dirty, dangerous, catastrophic mess.
But we can't stand by and let them do it. Telling the EPA to step in is the best way to build pressure right now.

The EPA recently gave ground on regulations for fracking on over 700 million acres of PUBLIC land.

 

The fracking chemicals do not have to be disclosed until after the well is drilled!

 

Well casings leak and drillers make mistakes.

 

Let’s hope this natural gas bubble burst before fracking pollutes underground water supplies that cannot be mitigated.

Fracturing rule offers a concession

WASHINGTON - The Obama administration on Friday unveiled a proposed rule that would force companies to reveal the chemicals they use when drilling for oil and natural gas on public lands.

But the long-anticipated regulation includes a major concession to oil and gas companies - allowing the disclosures after a well is drilled and the chemicals are pumped underground instead of a month beforehand as federal regulators originally considered.

The result is a proposal that satisfies neither the oil and gas industry nor environmental advocates.

The measure aims to tighten standards for production using hydraulic fracturing, a technique that involves blasting a mix of sand, chemicals and water underground to crack dense rock formations and release trapped hydrocarbons.

Fracturing is being combined with horizontal drilling technology to extract what analysts predict could be a 100-year supply of natural gas stored in shale formations across the country.

Energy industry leaders and their congressional allies complained that even with the concession on advance disclosure, the mandate proposed Friday would add unnecessary red tape that could discourage oil and gas production.

And environmental advocates - who fear chemicals and natural gas from poorly designed wells can leach into drinking water supplies - said it is important to know the chemical contents of fracturing fluids before operations begin.

"Knowing after the fact is nice but does not allow for any steps to be taken if the chemicals being used are of concern to the public," Rep. Maurice Hinchey, D-N.Y., said.

Industry officials say fracturing typically takes place thousands of feet beneath underground aquifers and is safe.

Texas already has rule
Several states, including Texas, already require that companies disclose their fracturing chemicals - with exceptions for proprietary information - on the industry website FracFocus.org. The federal rule probably would require disclosure there as well, and likewise contains exemptions for trade secrets.

Industry officials insist that states are better equipped to regulate hydraulic fracturing, given the wide geological differences from region to region.

Construction standards
The Interior Department's new rule would impose additional well construction standards, testing requirements and mandates for managing and storing water that flows back after fracturing begins. Interior Secretary Ken Salazar noted that the measure was built largely on existing "common-sense industry best practices."

Although it would apply only on public lands- representing just a small share of the nation's richest shale formations - some industry advocates say it could crack the door for more federal regulation later.

"This rule may only apply to public lands now," Sen. James Inhofe, R-Okla., said. "But let's not forget that Interior Secretary Salazar has publicly stated his hope to use these rules as a blueprint for federal regulation over state and private lands in the future."

The new rule could be viewed as a pilot pro-ject testing out federal regulation of hydraulic fracturing, said Benjamin Salisbury, an analyst with FBR Capital Markets. If the measure works without driving down energy production, it could be used as justification for future moves to regulate hydraulic fracturing in other areas.

At the same time, it forces all energy producers to follow best practices.

"Except for the paperwork requirements, the vast majority of the industry would not notice this stuff," Salisbury said. "But this isn't really about them. It's about the out-liers - the small producers, the rushed jobs, the low-probability, high-impact events that are the target of regulation."

The measure also could spur industry interest in fracturing fluids that have fewer chemicals.

Pollution from wells
The Environmental Protection Agency last month imposed a rule governing pollution from natural gas wells and separately Friday issued formal guidance governing the underground injection of diesel fuel as part of fracturing operations.

Under an energy law passed in 2005, however, the federal government is barred from regulating fracturing under the Safe Drinking Water Act - leaving most oversight in the hands of states.

The Interior Department estimates that the proposal would cost up to $12,000 per well, a tiny fraction of the typical total price tag for a well.

But energy companies worry about the cost of permitting delays while federal regulators review well construction plans and geological information that the new regulation would require. An analysis by Anadarko Petroleum Corp. estimates it could cost an additional $271 to $1,366 per well for every extra day it takes the government to process permits for those projects.

Hey folks,

As we decided at the last meeting, this month the CEC will meet on the first Sunday (tomorrow) to avoid conflicts with Mothers' Day next weekend.  We will meet tomorrow at 3 p.m. at the  Progressive Center (413 Waco Street).  Agenda items include 

-details on the May 7 hearing regarding the Sierra Club and CEC lawsuit against the TCEQ over its issuance of an air permit to Las Brisas in 2011, 
-a presentation by Samantha Duffy on the EPA's new source performance standards, 
-CEC consideration of joining the Environmental Integrity Project in its challenge to Flint Hills (of Corpus Christi) application for an amendment to its air quality permit,
-other issues as they arise.

Subject: Pat and Trudy in the hospital

Bad news.  Pat and Trudy Morris were in a car accident this morning.  They are in the hospital at Spohn Memorial.  They will be in overnight at the least.  Trudy was more seriously hurt with fractured vertebrae, ribs, and sternum.  She may require surgery.  We're still waiting to hear.  Pat suffered bruising to the chest from the deployment of the airbag.  Jerry Sansing is checking on whether or not it would be good to have visitors.  

We'll have a card for everyone to sign tomorrow at the CEC meeting.  I'll also arrange to send some flowers.  Donations accepted for this at the meeting or let me know.  


On the LBEC matter, Monday's court date is covered.
