Cellular Companies Evaded Rs. 47 Billion Sales Tax, NAB Summons Cellular Companies

Cellular companies operating in Pakistan were not paying taxes for interconnection charges, since 2007 for reasons not ascertained as of now. However, it is believed that cellular companies were relying on section 65 of the Sales Tax Act, 1990 to escape from taxes on revenues they earn from interconnection charges.

It merits mentioning here that interconnection charges of 90 paisas per minute are charged from customers for cross-network calls and is paid to operator that receives call.

Federal Board of Revenue somehow didn�t question the companies about non-payment of this sales tax but it was caught by FBR tax auditors in 2010.

When FBR asked these companies to pay the tax, the companies filed a case with the Commissioner Inland Revenue (CIR). The CIR told them to pay the tax, but cellular companies escalated the issue and filed an appeal in the Appellant Tribunal Inland Revenue (ATIR).

The Tribunal gave a decision in favor of interconnect charges. This was when all cellular operators appealed to the Chief Commissioner of Large Tax Unit with a plea that they were ready to pay tax from July 1, 2012, but asked him to waive the tax of the last four years, claiming the tax evasion had happened inadvertently.

Meanwhile FBR was evaluating the tax exemption application but probably it was too late as the file had hit the National Accountability Bureau table and matter came into limelight.

Admiral (retd) Fasih Bokhari, Chairman NAB, took suo moto notice and asked Chairman FBR to appear in person to explain details about defaulted amount.

Chairman FBR was also directed not to take any further action in terms of waiver of tax worth Rs 47 billion to cellular companies. Chairman NAB, along with, constituted a fact-finding committee comprising DG Operations, Director Special Operations and a senior Banking Officer of NAB to probe into the matter.

The Chairman FBR when appeared before NAB�s fact-finding committee, NAB officials pointedly questioned him on grounds for considering a tax waiver to cellular companies amounting to more than 40 billion (26 billion principal amount, default surcharge and penalty) based on interconnect charges.

Initially Chairman FBR said that he is going to give waiver to cellular companies. He (Chairman FBR) tried to convince the inquiry committee that waiver is in line with the law and he was intended to grant waiver on very next day. However, once he was confronted with evidence and supporting documents, he thanked NAB for timely intervention and guidance provided to him by NAB in safeguarding the interest of national exchequer and the interest of FBR.

He accepted view point of NAB and agreed on 4-point agenda.

No waiver whatsoever will be granted to cellular companies on grounds of interconnect charges.
He will depute his lawyer to get stay vacated by producing evidence in the honorable court which has been pointed by the NAB.
He will approach NAB where the necessity of recovery arises.
He expressed his commitment to work closely with NAB in larger interest of safeguarding the national exchequer.

Yesterday NAB has summoned representatives of five major cellular companies to know their viewpoint. Reportedly, representatives of all cellular companies held a meeting yesterday to figure out how best to deal with the situation.

It is likely that cellular companies will have to eventually pay the taxes, with some concession maybe, to get the file closed.

کون کہتا ہے توہین عدالت قانون کالعدم کرنے سے آئینی بحران پیدا ہوگا‘ عدالت عظمیٰ

- اسلام آباد(خبرایجنسیاں) سپریم کورٹ کے چیف جسٹس افتخار محمد چوہدری نے کہا ہے کہکون کہتا ہے توہین عدالت قانون کالعدم کرنے سے آئینی بحران ہوگا؟ ججوں نے ہمیشہ پارلیمنٹ کو چلانے میں اپنا کر دار ادا کیا ہے ، کون کہتا ہے کہ پارلیمنٹ کو نہیں چلنے دیا جارہا ۔ ججوں کا کام ہے کہ وہ فیصلہ کر یں اس سے ہمیں غرض نہیں کہ دروازے کے باہر کیا ہورہا ہے ۔ توہین عدالت کے نئے قانون کے خلاف آئینی درخواستوں کی سماعت کے دوران چیف جسٹس نے یہ ریمارکس دیے ۔ آئینی درخواستوں کی سماعت آج بھی جاری رہے گی ۔ جمعرات کو چیف جسٹس کی سربراہی میں 5 رکنی بنچ نے درخواستوں کی سماعت شروع کی تو سیکرٹری قومی اسمبلی نے توہین عدالت قانون پر ہونے والی اسمبلی کی کارروائی کا ریکارڈ پیش کیا ۔ لاہور ہائی کورٹ بار راولپنڈی کے صدر احسن الدین شیخ نے اپنے دلائل دیتے ہوئے مؤقف اختیار کیا کہ نیا قانون وزیراعظم کے خط لکھنے کے عدالتی حکم کے تناظر میں پاس کیا گیا‘یہ سب کچھ عجلت میں کیا گیا ، حکومت نے عدالتی کارروائی سے بچنے کے لیے قانون منظور کرایا تھا۔ ایک وزیر اعظم کو گھر بھجوایا گیا تھا‘ 12 جولائی کی حتمی وارننگ تھی‘ لہٰذا9 جولائی کو یہ بل دونوں ایوانوں سے پاس کرا لیا گیا اور صدرکے دستخط بھی ہو گئے ۔اس دوران جسٹس جواد ایس خواجہ نے کہا کہ پارلیمنٹ میں ہونے والی کارروائی کا عدالت جائزہ لے سکتی ہے ۔ آرٹیکل 63 کے تحت پارلیمنٹ کی کارروائی کو تحفظ حاصل ہے ۔ احسن الدین شیخ کا کہنا تھا کہ اگر صرف چند منٹوں میں قانون بنائے جائیں گے تو ان میں کوئی نہ کوئی سقم ضرور موجود ہوگا ۔ہم نہیں کہتے کہ پارلیمنٹ کو قانون سازی کا اختیا نہیں ہے ۔ اختیار ہے مگر کوئی بھی قانون آئین سے متصادم اور انسانی حقوق کی پامالی کی بنیاد پر نہیں بنایا جا سکتا ۔ اس پر عدالت نے کہاکہ قانون بنانے کے لیے کوئی نہ کوئی بنیاد ہونا بہت ضروری ہوتی ہے‘ مگر یہاں بنیاد تو دور کی بادت ہے‘ ڈرافٹس مین نے کافی غلطیاں بھی کر دیں ۔اس موقع پر چیف جسٹس نے کہا کہ عدالت اسمبلی کی کارروائی ملاحظہ کر سکتی ہے تاہم آرٹیکل 63 کے تحت اس کو تحفظ حاصل ہوتا ہے ۔جسٹس جواد یس خواجہ نے کہا کہ اسمبلی کی کارروائی سے بہت کچھ سامنے آرہا ہے‘اس سے کارروائی کو سمجھنے اور کیس کو آگے بڑھانے میں مدد ملے گی ۔احسن الدین شیخ نے کہا کہ ن لیگ کے کیپٹن (ر)صفدر نے مسودہ بنانے کے لیے عدلیہ سے پوچھنے کا کہا تھا ‘جس پر چیف جسٹس نے کہا کہ کیا ہم ممبران کے منشی ہیں کہ وہ ہر بات ہم سے پوچھیں گے ۔ ہم ڈرافٹس مین نہیں جو خط لکھنے کا متن پوچھ کر لکھیں گے ۔ احسن الدین شیخ نے کیپٹن (ر) صدر کی تقریر کا متن بھی پڑھ کر سنایا‘ جس پر چیف جسٹس نے برہمی کا اظہار کیا ۔ جسٹس جواد ایس خواجہ نے کہا کہ قانون کی شق دار منظوری کی کارروائی سے پتا چلے گا کہ آرٹیکل 248 ایک نکالا گیا ہے یا نہیں؟ چیف جسٹس نے کہا کہ قومی اسمبلی کی بحث میں یہ آرٹیکل نکالے جانے کا ذکر ہے ۔ شیخ احسن الدین نے کہا کہ قانون کی دفعہ 3 میں یہ آرٹیکل لکھا گیا ہے ۔ چیف جسٹس نے کہا کہ عدالت صرف قانون کی آئین سے مطابقت کا جائزہ لے گی ۔ احسن الدین نے کہا کہ نیا قانون توہین عدالت روکنے کے بجائے تو ہین کے طریقوں پر مبنی ہے۔ توہین عدالت کے مرتکب افراد پر پابند یوں کے بجائے بچ نکلنے کے راستے دکھائے گئے ہیں ۔ نئے قانون میں میڈیا کو آزاد عدلیہ سے الگ کرنے کے لیے توہین عدالت سے استثنیٰ کی ترغیب دی گئی ۔ احسن الدین نے کہا کہ حکومت نے دو افراد کو بچانے کی کوشش کی ہے‘ ایک صدر مملکت اور دوسرے پی پی کے شریک چیئر مین ہیں ۔ چیف جسٹس نے کہا کہ ہم آپ کی حمایت کر رہے ہیں اور آپ ہمارے ہی خلاف شروع ہوگئے۔ جسٹس جواد ایس خواجہ نے کہا کہ ہم نے آئین کی پاسداری کرنی ہے ۔ چیف جسٹس نے کہا کہ کون کہتاہے پارلیمنٹ کو نہیں چلنے نہیںدیاجا رہاہے ؟ہم ادارے کا احترام کرتے ہیں ۔ ہم جو فیصلہ کرتے ہیں اس پر قائم رہتے ہیں‘چیف جسٹس نے کہا کہ جج اخباریخبروں پر فیصلہ نہیں کرتے۔

MoU is a suicide note for Pakistan Rawalpindi, MTT News Desk: The renowned scholar & researcher, Syed Zaid Zaman Hamid says that the ISI and army must thrash MoU to see how the MOD under Nargis Sethi has been given powers to allow lethal supplies to and from Afghanistan.

He says that the analysis of the document and its dissection is necessary. "Why is this not made public when it seriously affects public interest and sentiments." He raised a question.

Responding to the various parts of so called MoU, Zaid Hamid says, "Despite clever play by the government of categorizing lethal and non-lethal supplies and allowing only "non-lethal" supplies for the US forces the truth remains that every kind of supplies would go to Afghanistan via Pakistan under different pre-text." he said further, "Some as humanitarian goods, some as support goods and weapons and military hardware as assistance to ANA." All the US/NATO operations in Afghanistan contain that tag of assisting ANA but the fact remains that it is merely a smoke screen.

He said that re-export clause is next big issue in MoU. It would allow the US to re-export its goods and weapons in case Pakistan prevent the flow of supplies after another US attack or any other reason. "Pakistan would be able to cease the supplies but not seize them."

"US would not pay a penny in tax. No transit fee or any remuneration for infrastructure." he said.

"In case of any damage to the US cargo, Commercial container carriers (mostly Pakistani) would pay the damages to the US. US would claim her damages as per MoU." Zaid Hamid said.

He said that in case of any dispute, Pakistan would not able to call on any third party entity and issues to be resolved bilaterally. "Pakistan will ensure security of US cargo."

The Saudi Arabian Airlines will implement a new baggage allowance policy on
international routes effective Sept. 1.

The new scheme is based on the �piece concept� as opposed to the current
�weight concept.�

The airline had informed all travel agents in the Kingdom. In a memo dated
July 31, the airline said that the new piece concept has been loaded in all
GDSs (Group Decision Support Systems) and it will be automatically
reflected on tickets of the passengers.
The specification of each bag would be length 90cm, breadth 75cm and height
43cm.

Currently, international travelers are allowed to carry 40 kg irrespective
of the number of bags.

�For instance, a passenger could carry three pieces, each weighing 10 kg,
or two pieces of 20 kg each, without inviting any surcharge,� said S.
Waheed Lateef of Azmeel Travel.

This will no longer be the case starting Sept. 1. According to the
memorandum, Saudia has specified that each economy class passenger will be
allowed to carry only one piece of 32 kg or less. For the first and
business class, the airline will allow two pieces of 32 kg each.
�For instance, if an economy class passenger has two pieces of 16 kg each,
he or she will have to pay extra money for the second piece,� said Lateef
