It is on the discretion of the case worker and there is nothing specified. I have been out for more than 180 days in total and 5 months at a stretch. It is all about how we do our paperwork and application. I know people who have got it for more days away and also know people who have been denied for just over 90 days or 180 days despite of providing all the proofs.

Hello Everyone,

I'm in a bit of confusion, I dont remember my exact date of Initial application which is required in the points calculator for calculating our extension points. I'm not sure it was 6 days or 7 days before visa was given. Please advice on this.

Intial Visa Valid From: 17-June-2009

Date of initial applicaiton: 9June-2009 to 11-June-2009.

Is it alright to take an approximation or we should know that exact date of applicaiton? Also, if need how can I determine the date of first application? -

Just get a letter from your company stating that you were travelling on business purpose. My friend was in a similar situation, he was out of UK for close to 9 months and he got his ILR 3 months ago.

This query  is regarding  ILR for my wife. 

I got married in March 2009 and my wife came to UK on Tier 1 dependent, stay in UK for 6 months(July’09 to Jan’10) and went back to India for 1 year (Jan’10 to Jan’11),Since then (from Jan’11 onwards) she is in UK. So if I calculate total period stay in UK it would be 2 years by our ILR application date.

As per the UKBA guide lines dependent has to be in the UK for 2 years to apply ILR and has to show the cohabitation proof for that. 

My queries are below:

1. how I can provide the cohabitation evidence; is it only the period she is in the UK(it will be 2 year)? Or the total period ? 

2. Does council tax, medical bills enough for cohabitation? if yes these issued once per year would that be OK? 

Kindly some one clarify my queries.

The visa that your wife has is dependant on your visa so you do not have to prove cohabitation.

Also 2 years should be fine.

There is no validity for Life in Uk test. Check the link below
 

Your Life in the UK Test Certificate does not have an expiry date on it. You should therefore keep it in a safe place until you are ready to submit the original with your application for Citizenship or Settlement.

We are not able to provide you with further copies of your test certificate. If you lose it, you should contact the Home Office who may ask you to take your test again.

sorry want aware of this. In this case a joint bank account or council tax/utility statement can be provided. I am assuming your spouse name will be on your passport and vice versa but you should also have marriage certificate attached with your application.

,I am working as an IT contractor and planning to go for first tier extension in March 2013, stamped before April 6th 2010. 

Below are 2 scenarios 

A) Employed 
currently on a PAYE and  Director of my limited company structure owing 100% shares and get  my salary on monthly basis and dividends quarterly.

below are documents for Visa extension 

1. Personal Bank account statements
2. An income certificate from accountant showing my income earned as monthly salary and quarterly dividends
3. Ltd Company VAT Registration 
4. Ltd Company PAYE registration 
5. Ltd Company Incorporation Certificate

B) Self employed.

Recently i was advice by one of my friend to go for a Self employed and register with HMRC as a self employed and bill my own limited company and raise monthly invoices for salary and expenses enough for visa extension. 

1. Self employed Bank account statements where salary credited.
2. An income certificate from accountant showing my income earned as monthly salary and invoices raised.
3. Self employed registered letter from HMRC. 

my question as below.

1) For visa extension which one is good as a (Self employed/ Employed).
2) As a self employed registered to HMRC can I raise my invoice to own limited company where I am 100% share holder.
3) Use Self Employed  invoices as my income for extension.

I have done my extension a few years back.

IMHO, employed is the best way to go. Answers below:

1) For visa extension which one is good as a (Self employed/ Employed). - Does not really matter. However, personally, i prefer employed.
2) As a self employed registered to HMRC can I raise my invoice to own limited company where I am 100% share holder. - 
3) Use Self Employed  invoices as my income for extension. 
4) Will dividends be a problem for Visa extension if we go ahead as a employed as most of the income we show would be from dividends rather than salary. - Not a problem, I did it that way.

Make sure you have got proof to back up everything that you propose, i.e. NI contribution statements( Even if nil), Business bank acct stats, vouchers, slips...etc

Its less complex to go ahead as employed
Dividends are part of your earnings as employed and considered for point calculation... Treated just as salary income

That's what i did for my extension being an IT cotractor

Hi Krish,

I applied for my wife on 7th May and her VISA came thru in 3 weeks... I applied from Mumbai North VFS.The current processing times I beleive is abt 14workin days. Tenancy agreement is not mandatory but a good to hv document as it is a proof of where u are residing and where she will eventually reside. Any Utility bill in ur name, if u have a UK driving license as well that shuld do. Alternatively you could do a hotel booking for her and then cancel it as per the cancellation policy probably just 1-2 days before u expectin her VISA to come thru.


However I still suggest some proof of residence is a must and a strong document proof.

What is the status of employment for an
IT contractor working through own limited company ?
He/she is the director of the company and not an employee.

As per HMRC (http://www.hmrc.gov.uk/employment-status/index.htm), this is not a matter of choice.

I feel the status of one will be self employed based on this site.

,I am working as an IT contractor and planning to go for first tier extension in March 2013, stamped before April 6th 2010. 

Below are 2 scenarios 

A) Employed 
currently on a PAYE and  Director of my limited company structure owing 100% shares and get  my salary on monthly basis and dividends quarterly.

below are documents for Visa extension 

1. Personal Bank account statements
2. An income certificate from accountant showing my income earned as monthly salary and quarterly dividends
3. Ltd Company VAT Registration 
4. Ltd Company PAYE registration 
5. Ltd Company Incorporation Certificate

B) Self employed.

Recently i was advice by one of my friend to go for a Self employed and register with HMRC as a self employed and bill my own limited company and raise monthly invoices for salary and expenses enough for visa extension. 

1. Self employed Bank account statements where salary credited.
2. An income certificate from accountant showing my income earned as monthly salary and invoices raised.
3. Self employed registered letter from HMRC. 

my question as below.

1) For visa extension which one is good as a (Self employed/ Employed).
2) As a self employed registered to HMRC can I raise my invoice to own limited company where I am 100% share holder.
3) Use Self Employed  invoices as my income for extension.
4) Will dividends be a problem for Visa extension if we go ahead as a employed as most of the income we show would be from dividends rather than salary.

Hello mate,

There are lots of technicalities surrounding it, which is best left to the accountants.

But to cut a long story short, you could either be the employed, director, share-holder or self-employed. Employed here means employed by your own limited company. A director being still employed by your own limited company.

The easiest way to get through the visa hoops (in my opinion, any way) is the employed-director way. That way your first proof of income will be dividend vouchers and salary slips with the bank statements as your second proof. 

You can also get an accountant's statement to cover everything, just to play safe.

I applied for my wife on 7th May and her VISA came thru in 3 weeks... I applied from Mumbai North VFS.The current processing times I beleive is abt 14workin days. Tenancy agreement is not mandatory but a good to hv document as it is a proof of where u are residing and where she will eventually reside. Any Utility bill in ur name, if u have a UK driving license as well that shuld do. Alternatively you could do a hotel booking for her and then cancel it as per the cancellation policy probably just 1-2 days before u expectin her VISA to come thru.


However I still suggest some proof of residence is a must and a strong document proof.

Family member of a tier 1 migrant (excluding tier 1 Investor dependants and  tier 1 exceptional talent dependants)

1.       If the Tier 1 Migrant is outside the United Kingdom or has been present in the United Kingdom for less than 12 months, each family member of the Tier 1 Migrant must show that he/she, the Tier 1 Migrant, or (for children) his/her other parent who is also legally present in the United Kingdom has at least £1600 to support him/her; this is in addition to any funds the Tier 1 Migrant needs to prove he/she has enough money to support himself/herself. Please note dependants of Tier 1 Investors do not need to satisfy the maintenance requirement.

2.       If the Tier 1 Migrant has been in the United Kingdom for 12 months or more, each family member of the Tier 1 Migrant must have £533 to support himself/herself.

3.       For example, the Tier 1 Migrant has been in the UK for 6 months and is making an application at the same time as his/her spouse and two children. He/she must show that he/she has £1600 for his spouse and a further £1600 for each child, in addition to £800 required for his/her own support. In total the family will require evidence that they hold £5600 in available funds (£1600 x 3 = £4800 + £800).

4.       If the same Tier 1 Migrant and his family had been present in the UK for two years, they would  require evidence that they held £2399 (£533 x 3 = £1599 + £800) in available funds.

5.       If a family member applies separately from the Tier 1 Migrant, there must still be enough funds to support each member of the family. Therefore in the example above, if the family has a third child, the main applicant has been in the United Kingdom for two years and the family applies for leave to remain for the third child separately, they must provide evidence that they have an additional £533 in available funds.

Further to the below what Sohel has mentioned, since Mar-Apr all applications have now become online for most visa categories and country as well. I applied from Mumbai North in India so the dependant application form needs to be filled online wherein u have the option to take date and day of appt. Print off the form and have to sign in and submit along with other supporting documents.

Can someone help me find out what is the salary threshold required for me for my extension in December 2013?I applied for hsmp assessment in February 2008 and initially my assessment was refused but afetr applying for administrative review,i got my assessment approved in April 13,2009.I then applied for hsmp visa on October 13, 2009 and then again my visa was first refused in August 2010 which was then approved and stamped in December 2010 after an appeal against the decision.
 
The visa was granted for three years and is due for extension in December 2013.I would be thankful forthe info.

Yes he can apply for extension based on his overseas earnings. However, no uplift ratio will be applied and he will have to come to the UK to apply either in person or make a postal application.

Hi Group,
On behalf of my friend who resides and works in another country than UK. Can he be eligible for Tier-1 extension?
If yes, though he wouldnt be claiming for UK Experience, will the earning in any other country would be accepted for points claim for earning in last 12 months?

Yes he can apply for extension based on his overseas earnings. However, no uplift ratio will be applied and he will have to come to the UK to apply either in person or make a postal application.
