Good Morning,

We are now up to 19,266 members and still growing strong. Sometimes I
wonder if anyone really appreciates what I do and the time I take to
maintain this group. Most of the time I get some really nice comments
from people that do appreciate what I do and the bits of new
information.

Last week I presented you with a new or rather old method of doing
things, but it works. Spokeo is a great tool, but that is it only a
tool. I have been finding it very helpful and it works. I liked it so
much that I created a gateway so that you can use it very easily.

Again I do this because I have been in the industry 32 years and I love

We are currently in need of a "good looking" male operative in his mid to late
40s, no older than his mid 50s for a special assignment regarding an infidelity
case.   Covert spy cam equipment could be useful.  His job pays $50.00 per hour

In light of the increasing incidents of email account hijacking etc the
following should be of interest to investigative and security professionals,
as well as their clients.

Symantic has released a 52-page report published in April 2012 entitled
Information Security Threat Report - 2011 Trends, Volume 17. This
comprehensive report relates the wide range of challenges facing computer
security professionals. Targeted attacks have been customized malware and
refined social engineering to gain unauthorized access to sensitive
information.  This is the next evolution of social engineering where victims
are researched in advance and specifically targeted.  There is also a
portion of the report dealing with attacks against handheld devices and
balancing the risks and benefits in "The Cloud."

Targeted attacks from industrial espionage exploitation of advance
persistent threats or what is now referred to as "APTs" have become a
buzzword and used and misused by the media but still pose a significant
threat. All rely on using a variety of means such as drive-by-downloads, SQL
injected malware, phishing and spam.

APTs differ from conventional targeted attacks and according to the report:

1- use highly customized tools and intrusion techniques

2- use stealthy, patient, persistent methods to reduce risk of detection

3- aim to gather high-value, national objectives such as military, political
or economic intelligence

4- are well-funded and well-staffed, perhaps operating with the support of
military or state intelligence organizations

5- are more likely to target organizations of strategic importance such as
government agencies, defense contractors, high profile manufacturing,
critical infrastructure operators and their partner ecosystems.

Cybercriminals are also learning new techniques from these attacks using
polymorphic code in mass malware attacks and spammers exploiting social
engineering on social networks.  The report also comments that APTs are
often aimed at stealing intellectual property and suggesting newer roles for
cybercriminals as information brokers in industrial espionage schemes.

The report is full of 2011 statistics regarding the extent of security
breaches, their types and targets, and the extensive information on targeted
email attacks against industry sectors.

"Somebody is watching you, somebody is tracking your every moment you are
online, comparing the practice to a private investigator following your

The Senate Commerce, Science and Transportation Committee heard testimony
from the Federal Trade Commission and the Commerce Department on the
guidelines both agencies have set down for privacy moving forward. The
hearing was held to further discuss President Obama's proposed online
Privacy Bill of Rights. The White House privacy bill of rights declares that
consumers have the right to control the data that groups collect on them and
the right of access to that data.

In his opening statement, Sen. Jay Rockefeller (D-WV), the committee
chairman, said he was concerned that the models of self-regulation proposed
by both agencies may not best serve the average consumer. "I believe
consumers need strong legal protections.  They need simple and
easy-to-understand rules about how, what and when their information can be
collected and used. They need easy-to-understand privacy policies rather
than pages of incomprehensible legalese."

FTC Chairman Jon Leibowitz and newly appointed Commissioner Maureen
Ohlhausen testified. She was once policy counsel for the Business Policy
Software Alliance, an anti-piracy group. The Commerce Department's general
counsel, Cameron Kerry, was also on the panel.  He is the brother of Senator
John Kerry (D-MA) who with Senator John McCain (R-AZ) has sponsored privacy
legislation to address similar issues. Senator Kerry, a member of the
committee, suggested that his bipartisan bill with Senator McCain could
serve as a starting point for developing standards.
Cameron Kerry's testimony stems from the fact that the National
Telecommunications and Information Administration (NTIA) of the Department
of Commerce is pushing discussions between various consumer groups to
develop "industry specific codes of conduct for privacy."

Members of the committee were not in agreement.  Senator Kerry and Democrat
members called for the implementation of the President's privacy framework.
Senator Pat Toomey (R-PA) did not see the need for privacy protections of
any kind.  He called for a cost-benefit analysis and stated for the
government to ask companies to alter their business model was irresponsible.
He doubted there had been actual consumer harm.
Senator Rockefeller stated in a world where the "Internet has fundamentally
transformed every aspect of our lives, unfettered collection of online data
poses significant risks.  He cautioned that self-regulation is "inherently
one sided" and that "consumers' rights always seem to lose out to the
industry's needs."

FTC Chairman Leibowitz countered by stating that the Digital Advertising
Alliance has made meaningful progress on the do-not-track and
self-regulatory efforts but also stated "We have to make sure do-not-track
is, with a few exceptions, do not collect."
There appeared to be no consensus on what privacy legislation is needed to
develop consumer privacy protections.

Since July 2011, ISPLA and our investigative and security professional
colleagues have expressed concern about the ongoing British investigation of
private investigators' actions in reference to the Murdoch scandal of phone
hacking and other questionable activities delving into the medical and
financial records of subjects at the request of UK media outlets.

ISPLA's Nicole Bocra and private investigator and investigative reporter Pat
Clawson have provided us with links to current UK coverage including a TV
expose that will eventually be replicated by others here in the U.S.

The Senate Commerce Committee last week announced that they too plan on
holding hearings on the same subject matter. Last year, the House Homeland
Security and Commerce Committees also called for hearings.

Mr. Clawson wrote in an email:

"In the United Kingdom, the Channel 4 (London) "Dispatches" TV
investigative reporting team is broadcasting the results of a
year-long undercover probe of illegal private investigation practices.
Extensive hidden camera video documenting misdeeds is featured in the
show, titled "Watching the Detectives."

The Channel 4 promo states:

"How safe are your secrets? Channel 4 Dispatches reveals how easy it
is to buy our most personal and confidential information. In a
year-long undercover investigation, private detectives sell us access
to health and criminal records, mobile phone bills and bank accounts.
The programme discovers the extent of the black market in personal
data and reveals how supposedly secure databases are open to exploitation."


Clawson further pointed out that "this is certain to cause an uproar, and it
is likely to attract
attention from American journalists and legislators...It would be a smart
move for private investigator trade associations in the USA to point out
that our PIs (unlike those in the UK) are carefully regulated by the
government and many of the practices described in the British broadcast were
long ago outlawed in America."

The following item may be of interest to investigative professionals
providing legal defense investigations to the indigent. ISPLA has been
intricately involved in working with several organizations concerned with
adequate funding of indigent defense investigations, including meeting with
various sections of the U.S. Department of Justice. The General
Accountability Office (GAO) report of May 9, 2012 provides considerable
reference material on this subject.

The Sixth Amendment to the U.S. Constitution guarantees every person accused
of a crime the right to counsel. States and localities generally fund
indigent defense services, and the Department of Justice (DOJ) also provides
funding that can be used for these services. GAO was asked to review federal
support for indigent defendants. This report addresses, for fiscal years
2005 through 2010, the (1) types of support DOJ provided for indigent
defense; (2) extent to which eligible DOJ funding was allocated or awarded
for indigent defense, the factors affecting these decisions, and DOJ's
actions to address them; (3) percentage of DOJ funding allocated for
indigent defense and how it was used; (4) extent to which DOJ collects data
on indigent defense funding; and (5) extent to which DOJ assesses the
impacts of indigent defense grants, indigent defense programs have been
evaluated, and DOJ has supported evaluation efforts. GAO surveyed (1) all
4,229 grant recipients about funding allocations and (2) a sample of 253
public defender offices about factors influencing their decisions to apply
for funding. Though not all survey results are generalizable, they provide
insights. GAO also analyzed grant related documents and interviewed relevant
officials. It recommended that DOJ increase grantees' awareness that funding
can be allocated for indigent defense and collect data on such funding. The
DOJ concurred with the GAO's recommendations.

ISPLA's has advocated that serious attention be given towards increasing
funding for investigative and expert witness costs when addressing indigent
defense issues.
