Right to Steal

 

Yesterday, I saw a sight we see almost everyday but never pay any attention to. I saw a auto-rickshaw driver come up a one way street the wrong way and then start to abuse another poor rickshaw driver who was in the right but couldnt move ahead thanks to this fellows stupidity and the crowd cheeredschool-kids-stuffed-auto-rickshaw the rickshaw driver who was wrong.

And the whole rush of thoughts came tumbling out.

The situation we are in is ridiculous. Everywhere around us we have started accepting the wrong and the illegal as the way to be. We have resigned to the thought that this lawless way is how India is. Its so bad that now if someone is in the right, they no longer have any voice to speak up about the injustice.

Last week, the auto rickshaws went on strike to protest, guess what…..the crackdown on illegal meters and fitness certificates. This means they are saying “allow us to use false certificates and tampered meters” or we will harass you by creating an artificial shortage……WRONG WRONG WRONG , its so horribly wrong.

In another example, I was driving down Matunga and a scooter came from a side lane to my right and blocked the opposite side of the road at right angle, waiting for me to pass. Another scooter which came from opposite at breakneck speed couldn’t stop and banged into him.

The person who was 100% wrong in coming half way across the road and  blocking the path despite knowing he couldn’t cross till my car passed started fighting with him. The public sided with him since poor thing was carrying a extra heavy precariously balanced load of eggs (illegally) which broke.

This week, I visited a discourse bySadguru Jaggi Vasudev (a very enlightened mystic) and he made a good point, he said our exposure to corruption doesn’t start from giving money at Govt. offices, it starts with us pushing our child ahead in the line, trying to get the movie tickets before someone else. That’s where we start training our child that to break the rules is good, to break the rules is ok. What do you think the child will do when he grows up ?

These are the same children who today have become our parliamentarians, they have been brought up this way and today have ended up so shameless since they see no wrong in what they do. How else would you explain the Govt on one end declaring the poverty line in India at Rs.32/- per day and on the other hand asking for enhancement of travel allowance by an additional  9 lakhs and new cars since the older ones used by the MLAs are uncomfortable.

Not only is the shame non existent but the insolence in face of law breaking is now so blatant that if you’re a citizen, the Govt in India says you elected us now shut up for 5 years. You cannot speak and have no right to speak till you need to vote for us again and extend our contract. If you do open your mouth despite this we will slap privilege motions on you.111110satish

The shameful fact is that our Ministers are Govt servants and as per standard accepted norms, servants need to be kept an eye upon by their Masters. Maybe even fired if they are not doing their job properly.

Friends, if you’re the kind of person who hires a manager and then allows him a free hand for 5 years to skim whatever money he wants from the company coffers and run the company in the ground without a review, there can be no bigger fool than you.

Believe me, if it was your company that had such a foolish set of directors pissing your money down the gutters, you would be breathing down their neck every day asking all sorts of questions, so why are you not doing this for your country ?

I am writing to WHO,newspapers, media, 50K my other email contacts abt this so : 
  1. An investigation by international organisation must be carried out in Indian Hospitals their ICU's and OT's to make sure that our hospitals are not carrying infections specially lung infection. 
  2. Daily a check of nursing staff / docs and their equipments must be made and sanitized  My father in law developed infection after he was put on ventilator and subsequently it was found that he has developed lung infection. Is ventilator the culprit. 
  3. Whether a law be made where hospital can not charge a patients if post 3 days of hospitalization new ailments develop.
  4. Doctors have to be available in large hospitals or their licence be cancelled. 
  5. Patients relatives must not be allowed inside ICU /ICCU but CCTV must be installed so relatives can see the patients and there care. 
  6. I am a witness of some cases where the saline needle shifted and whole hand was swollen and only when patients relative brought this dangerous situation to knowledge of nursing staff they ran to attend the patient. What is a remedy. Everyone else is punished for negligence but has ever been hospital staff been punished. 
  7. From the recovery or death with in one hour patient/ body must be discharged. Most hospital delay same and charge for next day too. What is a step govt going to take to stop fleecing the clients?? why so many cheats have come in this profession?? Is it because politicinas and bureaucrats run medical colleges charge huge donation and then docs recover same this way and finally continue to do so whole life?? 
  8. I have seen docs specially dentists who don't use disposable gloves, don't use proper cleanliness, hygiene, and staff is not trained. I condemn attack on medical professional but then what is a remedy for aggrieved relatives of patient???? Is law balanced to common man. I am fwd this mail to Indian judiciary and others too for waking up to sufferings of innocent patients and their relatives. 
  9. In a five star type fortis hospital in Jaipur there is no proper rest room for relatives of   ICU/ critical  patients and are made to sleep on floor and where as docs and hospital management  sleeps in 5 star apartments. But I equally condemn pathetic condition in which interns are made to live in hospitals and that is where they become cruel to others as they have faced all kind of inconvenience, sufferings and under payment. But shocking is is their not a single doctor in Jaipur Fortis / Ajmer Mittal hospital who is making lots of money ( whether patient die or live) to raise concern abt the inconvenience meted out to relatives of critical patients who are already so badly  stressed and in shock for critical condition of near one. 
  10. All hospitals should allow visit of another doctor of choice of patients/relatives to give second opinion. They be allowed to see all reports of patients  every 12 hrs. How can they play hide and seek?? Here I found Asian Heart experience abt patients relatives counseling ion daily basis very good system. Legally same must be made mandatory for all hospitals. Why should we chase a doc for feedback/ update etc like a beggar even after paying them huge money. I have seen many who have taken loan and paid to docs/ hosps and yet get miserable treatment where as if their VIP / filmi like Amitabh Bachan is there then they give hourly health bulletin because the doc gets to see/ and show his face on TV?? Are they more equal then other citizens of India??? Will supreme court have to order a system or will corrupt IMA and govt take some steps?? 
  11. When my mother in law was taken to hospital every other her belongings were removed but for nose ring ( or whatever u call ) studded with diamond as it was not coming out. On the sad day same was noted to be there by visiting relatives till 6 pm. At 7 pm she was declared no more. After that when body was handed over the nose ring was missing.We know of cases where from rooms of hospital things missing.We cant narrow down on anyone. But here she was in ICU and then handed over to realatives. Should not necessary law be made of taking inventory of such things on admission?? Should not there be a camera till the place the dead body is stored?? Will people at helm of affairs the docs, the management,the govt authorities wake up and do something as these things pile up ( like communal violence ) and then gets bursted like a volcano ( my close dear friend  doctor in Mumbai was gunned down some yrs back by a brother of patient who died. 
  12. And the biggest inhuman are TPA's and insurance cos who make run pillar to post patients and their relatives when u need them most. But IRDA,Insurance council, Ombudsman, consumer courts,govt insurers are all appointed by govt / bureaucrats so they are all chor chor mausere bhai who will reduce sufferings of common-man where VIP gets all work done in ziffy and we suffer as slaves in India. 



My father in law was admitted in fortis Jaipur  for stroke and paralysis attack but fourth day docs informed that he has developed lung infection.  I strongly feel these hospitals are carrying infections and specially lung. And lo he died on 7 th day of admission. 

My mother in law died exactly died 55 days days ( and she was hardly old enough ( 68 yrs) of lung infection. Nawab Pataudi died of lung infection. There r many other cses I know where people were admitted and then found to have  lung  infection. 

Similarly I have seen cases of persons admitted for High BP or heart attack. Hospital does necessary. But in the meanwhile there kidneys fail which were working well when they were admitted.

With deep regret I want to inform you the demise of my wife Rupali Sharma
on 17th July due to post operative complication after brain surgery.
 
I would also like to bring to your notice how private hospitals like
FORTIS are robbing people of their life and money. Please be very careful
while dealing with such hospitals. Find below the details of my experience
with Fortis Noida.
 
My wife age 29 ( occupation- trainer with HCL) was diagnosed with a non
malignant brain tumor on 17th June2011. She did not have any major
symptoms like headache, eye problem or vomiting. She was suggested surgery
for removal of tumor. We took opinions from Max, Indo Gulf and finally
decided on Fortis because of the good reputation of Dr. A K Singh.
 
Doctors did not make us aware that it is a very complicated surgery and
said that there are only incidental risks. "Amount of risk involved is
same as the risk when you come from your home to hospital"
 
On the date of admission I pointed out several times that my wife was
having severe cough and cold. It was ignored by doctors saying "Everything
is perfect". Later on Dr Sanjay Gupta admitted that this could have led to
infection.How could they ignore it? Moreover the doctor preponed the
surgery by one day because he had to go outside India.We were totally
unaware of that. Why did not they postpone the surgery instead?
 
From day one the team did not have any consensus on how the tumor will be
removed. They said that they will try from nose first , if not they will
cut open the skull. On the day of operation (8th July)they said after 5
hrs that they could not extract tumor through nose so .. they will open
the skull. My dear wife had to go through both the procedures. The whole
operation took 12 hrs.
 
Post operative care is pathetic. Why was my wife given sandwich and chole
chawal in ICU after next day of such a major surgery?My wife vomitted on
13 July morning and was drowsy. We immediately alarmed the doctors on
duty. But they ignored the situation saying that everything is normal. In
the evening she was perspiring, We again alarmed doctors on duty but no
action was taken. If the doctors have been proactive they could have saved
my wife.
 
By 14th morning the condition had deteriorated and doctors took her to ICU
and put her on ventilator saying it is not required but as a precaution
they were doing it.The worst part is that senior doctors A K Singh and
Sanjeev Dua went out of country on that day. We tried to reach them
through various means but they were not available for next 3 days. (How
could they leave two patients in such a serious condition?There was
another patient with similar case in ICU who also died )
 
Doctors who were available ( Vikas Gupta, Bundela, Sanjay Gupta ) acted
like bunch of idiots. They could not diagnose the problem and condition
deteriorated every day. There was total lack of leadership and no team
work at all. Each doctor gave a different reason for the problem ( lung
infection, hypo perfusion, brain infection none of which was confirmed by
the time of death). On 14th July, doctors were saying that there is lung
infection but they had not called any lung specialist. It is only when we
suggested , they called an expert? Why did not they call the experts on
there own?
 
On 16th July Dr. Vivek Chawla was instructed to update us the condition by
7:00 am in morning. However we were not informed till 11:00 Am that she
had a cardiac arrest at 4:00 am. My wife's cousin (who is a doctor in
AIIMS) visited Fortis Neuro ICU on 17th July , he told me that my wife was
already dead. After he left , hospital declared dead my wife. Otherwise
they would have continued with ventilator for god knows how many days. One
of the lady doctor in ICU very shamefully admitted that there was
negligence on part of doctors.
 
The hospital has international standards in only the exorbitant rated they
charge. They gave me an estimate of 2.5 lakhs to cure my wife and charged
Rs 5.5 lakhs for her deadbody. We were never communicated that the charges
had gone beyond the estimate. How could they expect us to deposit more
than double the amount at the time of death on a Sunday evening?
 
There was no doctor from Neurosurgery team available when the death was
declared. When we shouted at the authorities they were quick enough to
call the police within minutes. But they could not get any doctor to
confirm the cause of death or at least give a condolence message as a
human gesture. We had to immediately arrange double the estimated cost,
otherwise they would not give us the dead body.
 
We had a meeting with hospital management and team of doctors on 4th Aug.
Where doctors accepted majority of our allegations. We demanded a return
of the extra money paid and action against doctors. Director Mr Sukhmeet
Sandhu assured a response by phone in two days. After 8 days we received a
condolence message with no action.
 
Nowadays hospitals believe in profiteering even at the cost of life. There
is no trasparency and they put people on ventilator even when it is not
required. Very careless attitude of doctors, nurses and other staff. Again
warning you against such malpractices.
 
Kindly request you to forward this mail to all your friends and relatives
and request you to suggest me good lawyer/ agency who could help me in
dealing with this situation.

Happy Birthday Pops

 

I am almost 100% sure that today if Mahatma Gandhi ( who we call Father of our nation, lovingly referred to as Bapu) would have said “I told you so”

After we had gained freedom, It seems Bapu said to Manuben that he had lost faith in the Congress and he wanted it disbanded. He said they were no longer able to or willing to work along his principles.

Power politics prevailed and Congress remained.

This week has shown the wisdom of his words. In the last 6 months we have a PM declaring , he has no control of the country due to co-alition politics. We have a Finance Minister declaring he cannot control runaway inflation. We have a Home Minister who says he cannot stop terrorists attacks.

What can the Govt do? May I the common citizen of India ask ?

Today we have a Congress Govt who has in place a Finance Minister who says he sees Inter Ministerial Official Memoranda (notes) but doesn’t read them and passes them on ? That means almost all the “notes” seen by him and decisions made on them, can be recalled in future since he can claim he saw them but didn’t approve them.  Is this the form of Parliamentary Democracy the Govt is so desperately trying to protect.

We have a Govt which has a Minister who claims dementia and still wants toChidambaram_Smiling_295attend Parliament, and a Home Minister who announces in a Press conference smirking, that “he has a short memory”click here to view. In some circles that’s a sign of an unsound mind. I’m surprised that the journalists laughed, I would have screamed at him:

Is there anyone sane left in the UPA ? Dear Home Minister, please do remember that youre a Home Minister in charge of Police and Homeland Security and that we have terrorist attacks regularly and that something should be done about them. If your “memory loss” is genuine, please resign immediately to save the lives of our brave officers.

This kind of callous joking in the face of terror attacks which cost Indian lives is a slap in the face of the families of the martyrs, be it RR Patil and his “chote Mote Haadse” comment on the Mumbai attack or Chidambram on his “short memory” remark on such a serious issue. It is symbolic of the problem facing Indian Govt today.

Earlier when we visited Govt offices, the fat babus sitting behind their desks were not afraid. They knew their jobs were secure so they behaved disgracefully with common people. Chidu and the rest of the Govt are doing the same. They are complacent and cocking a snook at us from their lofty chairs saying “touch us if you dare for the next 2 years”.

RR Patil was removed as Home Minister in an eyewash, he came back as soon as the public attention was misdirected and today Mumbai is as unsafe as it was, in fact more since the thieves have seen the path and they know the worst they will get is a bullet and matyrdom or a tonne of attention and biryani.

Chidu knows nothing can touch him which is why he can record a soundbyte confession which technically disqualifies him from a Ministerial or even a Parliamentarian post under Sec 191 of the Indian Constitution (click here to read). Whats the worst that can happen, if people catch on, he will go on record and say like Pranabda and say  that “he said the words, but they weren’t his”, and people will go about their happy ways thinking matter is closed.

Folks, Bapu is dead but we are not. Anna showed us the way for which I will be eternally thankful to him and for which he must go down in the annals of history. His words “ I am Anna, you are Anna, we all are Anna” in my mind reflects “ I am Bapu, you are Bapu we all are Bapu”

Let the Bapu in each of us arise on this Occasion of his Birthday and stand up and say “I AM BAPU” and I am a proud proud Indian and no Govt is going to grind me to the ground.

To those detractors who will bombard me for misusing the Gandhi ( In my mind there is only one true Gandhi, rest are just a surname) name.

I ask you to look in the mirror. Today Tushar Gandhi (Bapu’s greatM_P_1_114458f Grandson) has written in Times Life that Anna showcased that as long as the ends were noble the means did not matter. This, Bapu, would not agree with.

Let me see, Hmmmmm…isnt this the same Tushar Gandhi who sold the Mahatma’s name to a pen company in return for a cheque to a foundation which according to him was a noble cause and that the end justified the means….ROFLMAO

I love these holier than thou people, they make my Sundays.

The famine in Somalia could kill 750,000 in the coming months, and tens of thousands have already died. When you meet at the Group of 20 (G-20) Summit in November, you have the opportunity to break the cycle of famine and ensure people are hungry no more. Lives are in your hands. Please keep the promises you have made to the 2 billion poor people who depend on farming for their livelihoods.

The reasons for the famine in the Horn of Africa are complex and solutions are difficult, especially in Somalia, but we can’t lose sight of some simple facts:

1. 30,000 children have died in just 3 months.  Thirty thousand.  With over 12 million people at risk. 

2. Famine is not a natural catastrophe – drought doesn’t have to lead to famine.  It can be prevented, as we have seen in much of Kenya and Ethiopia.  

In the 21st century, it’s an obscenity that people are dying because they can’t get enough food to eat.  Every one of those 30,000 children is part of a family – a son, a daughter, sister or brother.  We can’t imagine what it must be like to starve to death, but most of us know what it’s like to lose someone we love.

Please watch the film and make use of the voice you have -- sign the petition.  It will make a difference in putting pressure on world leaders to do more to help those in need right now, and live up to promises already made to invest in the things proven to work – early warning systems...irrigation...drought resistant seeds… and of course, peace and security.

My Mission Statement is:

A lot of people have written in asking why do I write these articles?

My answer is simple.

We meet loads of people everyday. When we stand around talking a lot of issues are discussed, what I hope and see happening is that the next time one of the readers starts a conversation on a topic I have written about, at least they will talk about it from a new viewpoint from the rest.

Which is why I talk about all aspects on life in India be it the Ram Setu Bridge or the Elections or maybe even the latest soap on TV.

No further SIC has been appointed so far, for Mumbai Division of MSIC !

Apart from appointing the required IC, the Commission is besieged with problems like the quality of IC's orders and even more importantly the non-compliance of IC's orders?

The PIO, FAA & ICs none of the three levels of RTI works optimally, yet the RTI Act works!!!!! simply because it is a Citizen Empowering Act, landing up citizens themselves with a right to seek information at the door steps of one and all in the government, from the lowest in the hierarchy to the highest !

  1. The grounds for appeal: The PIO has not bothered to reply. The First Appeal Authority has also not bothered to reply.

  1. Particulars of information:  We require information as desired in our RTI application, we also require order of first appeal authority. We also request for necessary penal action and other departmental action against PIO and First Appeal authority fro purposefully ignoring to reply. earlier too we have made several complaints and written requests and RTI applications which they have wilfully and in the interest of very influential and monied gems and jewelry exporter not taken any action inspite of all necessary evidences furnished to them.
  1. Nature and subject matter of the information required: Shri Madhukar Purohit had shifted to Jaipur years back. He has all his records, business, palatial bungalow,several cars, telephones, mobiles, education of his children during period in question in Jaipur. Therfore as per law in question he ordinarily resides in Jaipur and thus his name ought not to  have appeared in Mumbai. I brought out this fact with all necessary documents to Election authority. Inspite of this his name was not deleted form record as he gave written declaration on oath before election officer that his name does not appear in Jaipur or anywhere else in India. On the basis of this election officer continued his name in election roll.

           I collected certified record from election roll of Rajasthan and produced before the same election officer with a request to take action as prescribed in law for giving false affidavit on oath before election officer , for having names in two different states of India and pursuing hard with false documents and claims the desire to retain his name in Mumbai / Maharashtra too in spite of having in other state. For years they have failed to take action. I have raised RTI application on same issue and once again concerned officers have willfully and connivingly not replied to my any of the applications.

Relief Sought: A) Please instruct PIO to give desired information.
B) Pl. levy penalty on the PIO under section 20 (1) of the Act 22 of 2005 for not providing the information as mandated in the law. PIO has no reasonable cause for not replying to my RTI application.

PUBLIC RESPONSE IN AFFIDAVIT

I, N. PONRATHNAM as the public (citizen of India), a person having through knowledge of Electricity, as Consumer of Electricity as defined in subsection 15 of section 2 of Electricity Act 2003, and son of Late Shri P. NADARAJAN aged 42 years self-employed in Vel Induction Hardenings, 25 Majithia Industrial Estate, Waman Tukaram Patil Marg, Deonar, Mumbai – 400 088, solemnly affirm and say as follows:

 

The Applicant had down loaded the copy of the petition from MSEDCL web site and has gone through the petition in detail. The Applicant would like be heard in person at the public hearing scheduled to be held in the Conference Hall, 7th Floor, CIDCO Bhavan, CBD Belapur , Navi Mumbai, on 23rd October.  The objection comments and suggestions made in the affidavit are as below.

 

A. Jurisdiction to entertain the petition

1.         Is MSEDCL in compliance to section 12 of Electricity Act 2003?

MSEDCL is a company as per companies Act 1956 and do not fall under any the following any local authority, Panchayat Institution, users’ association, co-operative societies, non-governmental organizations, or franchisees: to exempt complying to Section 13 of Electricity Act 2003. MSEDCL has not been authorised u/s 14 of Electricity Act 2003 till date. MSEDCL has not been declared as a deem licensee by MERC nor has issued specific condition of supply regulation as done to all other distribution companies in this state. The creditworthiness of Petitioner should be checked and declaration of deem licensee should be given by MERC as given to other distribution companies in the state. Fresh Licensee with required license condition should be issued.

 

B. Obligation to supply quality uninterrupted supply. Differentiation of consumer for power cut by MSEDCL (Philosophy of load shedding)

2.         Is it mandatory or optional for the distribution licensee to ensure continuous (24hrs a day / 7 days a week), quality and reliability of supply of power to the consumer?

The obligation to supply without load shedding (Power-cut) for the petitioner is specified in section 24(1a) of Electricity Act 2003 and section 17 of Maharashtra Electricity Regulatory Commission (Electricity Supply Code and Other Conditions of Supply) Regulations, 2005 and commission has power to revoke the license (the authority to distribute) in case of failure. Load Shedding should be defined as the deficiency of the Distribution Company when the company has not made the provision for demand of the consumers. Electricity Act 2003 does not discriminate the consumers.  The standard of performance Regulation of MERC have been silent on MSEDCL to comply in Rural area of Maharashtra and orders of MERC on load shedding protocol is violating the provision  Electricity Act 2003. Those orders violating the provision Electricity Act 2003 should be made null & void. Electricity is supplied at subsidised for cost the dieing Agriculture sector to survive. How can the standing crops survive with inadequate water supply with high hours of Load shedding to Agriculture done by the petitioner?

            There is no excuse for the deficiency in supply.

 

3.         The provisions of the act compel the petitioner to supply without Power-cut (uninterrupted) and do not give room for non-express feeder to exist.

 

C. Reliability Charge levied by MSEDCL is illegal

4.         There is no provision in Electricity Act 2003 to differentiate consumer based on capacity to pay / willingness to pay.

There no provision to differentiate the tariff levied to particular category of consumers of same distribution company residing in different town of the state.

There no provision to differentiate consumers based on the distribution loss/ collection efficiency.

 

D. Tariff Philosophy

Restoration of Fixed Charges

5.         Arbitrary fixation of tariff is not envisaged in the Electricity Act 2003. One of  the main principle in the Electricity Act 2003 is that the distribution company gets its revenue requirement. Other main principle in the Electricity Act 2003 is that the revised tariff should not give tariff shock to the consumers. Depending on the usage and the method of charging 100% increase in fixed charge may lead to exorbitant charge in the consumers’ bills. Tariff shock has not been precisely defined but increase in bill should not be more than 8.3% of the existing bill.   The tariff should reflect the cost of supply. The petitioner has never determined the Cost of supply for each consumer and tariff is fixed arbitrarily without rhyme or reason. This issue was raised in the previous petition also by the Petitioner. My submission is that consumer should have the choice of selecting the method of charging depending on the basis of his usage. It is very similar to the concept of charging by Rs/MW/day and Rs/kWH for wheeling. Hence the very concept of recovering fixed cost by fixed charges should not be entertained.

            The generation / transmission as well as distribution apparatus operate at high load factor. But low end consumer cannot be expected to maintain high load factor. Though the aggregate load or coincidental peak for the petitioner has always been less the revenue from low end consumers aggregate is always more. So the raise in fixed charges should not be arbitrary.

100% Hike in fixed charges

            Is it correct on the part of MSEDCL to ask 100% hike in the fixed charges?

Whether MSEDCL has calculated the cost of supply?

What should be the ratio of fixed (demand charges) to variable charges (energy charges)?

Whether the consumer could have an option of having different method of charging? Similar to what we have in internet broad band services / telephone services. Consumer could avail unlimited energy consumption paying fixed charge per month. Consumer could avail unlimited energy consumption paying fixed charge per month for a particular time of the day. Consumer could avail to pay based on the energy consumption with out paying anything more as fixed charges. Consumer could avail supply to be used only at off peak period at attractive price.

The increase in tariff should be in line with increase in the price of the input of generation of Electricity.

 

Rebate to HT Industries during Off-peak period

 6.        Encouraging usage of electricity during off period to flatten the load curve should be the main motive for the petitioner. The HT industries have a motive to work at off period to improve there load factor and maintain lowest possible demand round the clock. This motive should be inducted to all the electricity consumers. Hence the rebate only to HT consumers will not be as effective.

 

Billing Demand during off peak period

7.         Incentive / disincentive on kWh (energy consumed) or on kW (demand recorded) final goal is to achieve a flat load curve at Transmission-Distribution interconnection. Waive Levy of demand penalty on off peak hour could be one of the excellent incentive for usage at night. Load factor incentive is achieved in two part tariff and additional incentive as   â€śLoad factor incentive” is not required. To further enhance the incentives the Demand recorded during off peak hours should not be considered for billing purpose.

 

Energy Charges for Domestic Consumers as per landed cost of Power Purchase

8.     There is a road map required to reduce cross subsidy with out tariff shock. Increase has to be done but gradually.

 

Subcategory in HT and LT Commercial

9.        Creation of any new category is violation of the section 62(3) and 61(g) of the Electricity Act 2003. Educational Institution, Charitable Trust and Hospitals where placed along with residential consumer category as subsidised category for ages and late tariff order had considered placing them in commercial category which is a subsidising category.

            Differentiation of private and government is not inbuilt in the provisions of the Act.

 

Additional consumption slab in LT Commercial

10.       Differentiation based on consumption of electricity is violation of the provision in the section 62(3) of the Electricity Act 2003. The telescopic tariff existing in residential category is violation of the provision in the section 62(3) of the Electricity Act 2003.

 

Fuel Adjustment Charge (FAC)

11.       Fuel adjustment charge has been a issue with the petitioner not complying with section 62(4) of Electricity Act 2003. Increasing the ceiling of 10% cap of FAC has been debated by MSEDCL. Fuel Adjustment Cost (FAC) is charged as maximum limit of 10% on Energy Charges as per MERC Regulation. MSEDCL has prayed for recovery of cost of power purchases in the pretext of FAC charges is not in any provisions of Electricity Act 2003 and Tariff Regulation framed by MERC.  Only the price rise of fuel explicitly mentioned in the power purchase agreement may be allowed.

 

Voltage surcharge

12.       MERC regulation prescribes voltage limit for the load range. MSEDCL due to various constrains not able to comply with the regulation levy voltage surcharge. Differentiation of levy of tariff (in the form of voltage surcharge) for consumers at same voltage drawing higher load is violation of the provisions of section 62(3).

 

Uncontrollable cost

13.       Distribution companies are supposed to estimate the cost incurred and the revenue collected. Considering all power purchases as uncontrollable and also the revenue collected (incentive given) as uncontrollable by the petitioner is baseless.

MERC laid the methodology and principle for determination of tariff as per sub section 2(a) of section 45of the Electricity Act 2003. The tariff determined by the distribution companies should have higher prudence check by MERC as the petitioner is not sure of his submissions.

 

            Multi year tariff (MYT) principles

14.       Commission has laid down the Multi year tariff (MYT) Regulation 2011complying to  Section 61 (f) of Electricity Act, 2003 (EA 2003) and National Tariff Policy, 2006. The petitioner should explain in detail all his issue for not able to comply principles laid down by the commission.

           

            Consumer Space used by the petitioner

15.       The Honourable MERC to direct electric companies to enter into formal agreements for space required for distribution transformers complying with the Section 5.5 of MERC (Electricity Supply Code and Other Conditions of Supply) Regulations, 2005.

           

Wheeling charges / wheeling losses

16.       Calculation (philosophy) of Wheeling charge and wheeling losses to be levied to open access consumers has not been spelt out in the petition.

  1. The grounds for appeal: The PIO has not bothered to reply. The First Appeal Authority has also not bothered to reply.

  1. Particulars of information:  We require information as desired in our RTI application, we also require order of first appeal authority. We also request for necessary penal action and other departmental action against PIO and First Appeal authority fro purposefully ignoring to reply. earlier too we have made several complaints and written requests and RTI applications which they have wilfully and in the interest of very influential and monied gems and jewelry exporter not taken any action inspite of all necessary evidences furnished to them.
  1. Nature and subject matter of the information required: Shri Madhukar Purohit had shifted to Jaipur years back. He has all his records, business, palatial bungalow,several cars, telephones, mobiles, education of his children during period in question in Jaipur. Therfore as per law in question he ordinarily resides in Jaipur and thus his name ought not to  have appeared in Mumbai. I brought out this fact with all necessary documents to Election authority. Inspite of this his name was not deleted form record as he gave written declaration on oath before election officer that his name does not appear in Jaipur or anywhere else in India. On the basis of this election officer continued his name in election roll.

           I collected certified record from election roll of Rajasthan and produced before the same election officer with a request to take action as prescribed in law for giving false affidavit on oath before election officer , for having names in two different states of India and pursuing hard with false documents and claims the desire to retain his name in Mumbai / Maharashtra too in spite of having in other state. For years they have failed to take action. I have raised RTI application on same issue and once again concerned officers have willfully and connivingly not replied to my any of the applications.

Relief Sought: A) Please instruct PIO to give desired information.
B) Pl. levy penalty on the PIO under section 20 (1) of the Act 22 of 2005 for not providing the information as mandated in the law. PIO has no reasonable cause for not replying to my RTI application.

As a lot of heat and dust is being raised on the Planning Commission's affidavit to the Supreme Court on determining the new poverty line based on a day's earning of Rs 32 by person, the parameters of poverty seems to have lost any meaning for country's policy planners as the average income of a minister in the Manmohan Singh government increased by Rs 3.3 crore during the last two years.
“The average asset value of a minister in the current ministry is Rs 10.63 crore. In 2009, the average asset value of a minister was Rs 7.3 crore. Thus the current ministers on an average are Rs 3.3 crore richer than in 2009,” says NGO, Association for Democratic Reforms (ADR) in its detailed analysis of ministers’ assets made public recently.

ADR, which has been keeping a constant watch on the behaviour of country’s law makers after the Supreme Court had made declaration of their assets and criminal antecedent mandatory in 2002, got the analysis done by their activists Anil Bairwal, professor Jagdeep Chhokar and professor Trilochan Sastry after the PMO had made public the details of the wealth of 59 ministers.

There is every likelihood of further change in the figure of Rs 3.3 crore average increase in the asset value of the UPA ministers as 19 of them have not yet made public the details of their wealth, the ADR says.
Of the 59 ministers who declared their assets, DMK leader S. Jagathrakshakan’s wealth witnessed a phenomenal increased of Rs 64.4 crore during the last two years. He had declared his assets worth Rs 5.9 crore during 2009 elections but a statement sent by him to the PMO now showed his wealth worth Rs 70 crore, according to the NGO.

However, 'poverty' has stuck some ministers with 15 of them registering a marginal decrease in the net value of their assets as compared to declarations made during 2009 elections.

For petrol, Indians shell out the most in the world

Data of retail prices in countries across the world shows that Indian prices are amongst the highest in the world at current exchange rates.

Even a simple comparison of retail prices in different countries by converting them to Indian rupee reveals that petrol in India is more expensive than 98 other countries.

The second group comprises of countries like the US, Iraq, Indonesia, etc, where minimal tax is levied on petroleum products. They also have lower prices than India.
A litre of petrol costs Rs 42.82 in the US.

At Rs 69.90 -the average price of petrol in 24 Indian cities -Indian prices are now comparable to price of petrol in EU.

Despite huge subsidies, diesel is more expensive in India than 136 other countries. Costing $2.46 at PPP, India is 23rd most expensive in diesel prices.
Can anybody explain why Indians have to bear this unbearable burden?

I write this letter to inform you that well-placed members of your Government have expressed to me in confidence their disgust and sorrow at the open interference into the functioning of various Ministries by the two sisters of Ms Sonia Gandhi, namely, Ms Anushka Vinci and Ms Nadia who are Italians citizens but now frequently reside in 10, Janpath, New Delhi which premises had been allotted to their sister Ms Sonia Gandhi.

The problem is the undue and uncalled for interference by these two ladies. This has national security implications since not only they are citizens of a foreign country (Italy) but their activities in Dubai and London reveal their contacts with unsavoury and anti-Indian characters. Their mode of travel by private jet which are owned by dubious characters accentuate the national security threat. As you know that the conditions of their Indian visa do not permit these activities and in fact warrant the cancellation of their visas.

Hence I request you to make a suitable enquiry by officers of RAW and Intelligence Bureau who are known not to have improper proximity with the family of Ms Sonia Gandhi and her siblings. I strongly urge you to see that these ladies be deported from India to Italy if they continue such activities.

yeh news pad kar aaj ka din khrab ho gaya : 

LIC the only proud flagship corporation of Govt of India which has been acclaimed the world over is being given a slow poison by enemies of India , and sonia and Manmohan are becoming tools of same. 

LIC has earned shame and disrepute by asking agents to sell ULIPs by over promising and giving rosy pictures and thus millions specially poor and middle class have made heavy losses. LIC is not bailing out them. Manmohan not asking LIC to bail out its investors who have made losses due to false promises given by LIC thru agents and before the last day of closing of those ULIP's the branches of LIC were collecting premiums till dawn next day. Poor villagers and others have morgaged their personal belongings and valueables and taken ULIPS and now these ULIPS are in loss. Many LIC clients have it seems committed suicide due to losses. Has ever Manmohan / Sonia / Digvijay/ Kapil Sibbal / Prafull have ever thought of bailing out any of loosing poor investors of LIC???? Why ????

And why are they trying to bail out Vijay Mallaya the person who spends time on beaches shooting for loust naked girls calender, in IPL, in Car race in alcohol trade etc etc .. 

What are there connections with him???? 

My marathi manoos bai who worked in various houses as domestic servent is bed ridden due to damage to backbone ( paraplegic), her husband  already had paralytic attack.

They have two daughters. One has taken over her mothers work and other is studying. They r unable to meet their expenses. I asked them to get a BPL  card so that they can be treated in good hospital for free. The marathi manoos officers asked for huge bribe and gave lenghty procdure for illetrate , ailing poor senior citizens. But one who lands today from UP/Bihar / bangla desh  gets taxi / auto permit/ unauthorised hut and then free house/ unauthorised stall and they are all helped and saved by marathi speaking officers. Why??? 

Garibi hatao or illigal migrants are only issues to raise sentiments and get votes but at the end of the day who is the winner won who bribes. Aur mera hindusatan mahan?????? Shame and sorry for those believe in these leaders.

The pictures attached are some of the work I am invovled with and my travels into orissa and chattishgarh, poverty and life that has left an indelible mark in my soul. 

The last collection, i did was for the 63 orphan kids from a village kutru in Chattisgarh(18 cartons of shoes toys clothes, water purifiers). The picture attached is of its distribution in a local daily newspaper. The act of donation and direct delivery changed the lives of those kids forever, the collector ashamed, alloted a piece of land for a proposed school and donated a cheque of 6.5 lakhs towards their shelter repair.

The present drive is for the villages I visited and stayed in Orissa. This time I have tied up with The Youth Parliament(its website and details are below) for a more organized and large scale donation drive. The district is Kendrapada. 7 blocks out of 9 are affected(fotos and details are on the link below)

The money will be for the costs of packing and freight to Kendrapada. The balance money will then be personally handed to the affected villagers by YP and myself, during our visit to Kendrapada in Feb. All details of donations will be put up on the website for transparency.

We all know how the government machinery is and direct intervention, its benefits; which we realized with our efforts in Chattisgarh. I do hope you can share this email and also donate towards our cause.

Kejriwal declared assets in 24 hrs, why can't PM, MPs, judges do so?

The Congress & UPA government has to answer a simple question: if the government is sure that no politician, bureaucrat and judge is corrupt, why fear framing a strong Jan Lokpal bill? Precisely because it is not sure, it is unable and unwilling to do so. This is giving enough fodder for people to fast against corruption.

UPA also argues that Lokpal will become a monster, eat up Parliament, Judiciary and Government, that it can't be supreme to all of these while not being accountable itself. Civil society’s intent is perfect but it has unfortunately fed into this argument – it hasn’t worked out the finer points of accountability of Lokpal – some sort of judicial review of its orders are possible – but that’s not solid, not as much as Parliament, Judiciary and Government being subject to Constitution.

If civil society can ensure Lokpal's accountability to the people, just as it is asking the three arms to be accountable to people too, if it can convince the country that Lokpal will not be superior but equal to the three arms and that it can be called into question by people, represented by Parliament or any other representative institutional body, fears of UPA or any other government at the Centre would have to thin.

Can't the UPA meanwhile take the lead to do this? What’s the fear in bringing PM, judiciary, Members of Parliament under scrutiny if none are corrupt? If Arvind Kejriwal can declare his assets within 24 hours of being asked to do so, what’s the fear for PM, MPs and judges to do the same? If they can’t, there’s something to hide or there’s too much wealth that they’re embarassed to declare.

If civil society clears doubts that it won’t have a Lokpal superior to the people (people’s representatives), there wouldn’t be excuse for UPA not to frame a strong Lokpal bill.

No one can disagree with the pragmatic demands of civil society – declare assets, books the corrupt, hold the highest institutions accountable including the highest office of the land. How to make them accountable, which agency will do so and how to make that agency accountable is at the centre of the present anti-corruption movement.

It is such an efficient antibiotic that it not only kills dangerous bacteria in the human intestine when it's cooked with food, but it can also neutralise parasites when applied as a paste on wounds. And adding haldi to dals is a simple way to allow the body to digest dal better; most dals are difficult to digest and cause gas.

Recently, Austrian scientists reported that haldi protects against liver damage that eventually causes cirrhosis. Curcumin, the active ingredient that gives turmeric its characteristic yellow colour, reduces inflammation that causes liver cell damage, blockage and scarring in eight short weeks, reported Gut, a British medical journal.

Turmeric has been used since ancient times to boost the body's immune response. In fact, it is one of the few spices allowed in khichidi for babies above six months of age. In 2007, U.S. researchers reported that curcumin helped stimulate immune cells among people who had Alzheimer's, slowing the progression of the degenerative disease. Later that year, Clinical Cancer Research reported that curcumin effectively blocked the activity of a gastrointestinal hormone implicated in the development of colorectal cancer.

Its anti-inflammatory properties were not only found to relieve the aches and pains of arthritis, but also prevent it, said a study in Arthritis and Rheumatism, the American College of Rheumatology journal. International studies have also shown it suppresses cancer tumours and that people who ingest a lot of turmeric are less prone to the disease.

So how do you include turmeric in your diet? Here's how: Add it to dals and vegetables. Add it to milk for children along with jaggery. Add it to rice or atta dough, stews and soups, especially if you have runny stools or any infection. Add it to milk if you have bruises and internal injuries.

All clients must insist estimate / proforma in writing before appointing an advocate. Like architects association has made a format for billing and giving estimates similarly Bar must come out with similar format. If estimate / proforma is not accepted and signed by client then version of client must be believed.

Pl. note that in Insurance and credit card agents r openly  advised that dont sell same to advocates and police. Why?? Why integrity of advocates r doubted??

When in life first time I approached an friend advocate for an advocate cautioned that I don't practice on that side of court but be cautious as in property matters advocates get sold out.

And in MACT I found that the original advo did not do anyting for 3 years andwas busy running a konkani hotel. Then I appointed another from my community. and she cheated me in fee and till then she saw that I dont get cheque from MACT.

And so .

Acting on the complaint of professional misconduct filed by Adv. Aires Rodrigues the Bar Council of Maharashtra and Goa has issued notices to Mumbai Senior Advocate Amit Desai and Panaji based Adv. Ashwin Bhobe.

The Bar Council has given Adv. Amit Desai and Adv. Ashwin Bhobe 15 days to file their reply to the complaint filed against them.
 
Adv. Aires Rodrigues in his complaint under Section 35 of Advocates Act, 1961 has drawn the attention of the Bar Council that Adv. Amit Desai had fraudulently raised bills and had claimed Rs five lakhs for four hearings he never appeared for before the Bombay High Court at Goa in the Ryan Fernandes death sentence confirmation case.
 
Adv. Rodrigues in his complaint has stated that under the terms of his appointment Adv. Amit Desai was only entitled to a fee of Rs 1, 25,000 for every appearance in the case before the High Court and that he was not entitled to any fees for conferences he now claims were held at a Panaji hotel.
 
Adv. Rodrigues in his complaint has further stated that Adv. Amit Desai’s raising the bills was a clear act of cheating, while Adv. Ashwin Bhobe had criminally conspired and corroborated in the act by submitting those bills to the government knowing that the bills were falsely raised.
 
Adv. Rodrigues has also stated that the bills raised by Adv. Amit Desai were forwarded and pursued by Adv. Ashwin Bhobe who was fully aware that Adv. Amit Desai had not appeared for those four hearings and was fraudulently claiming Rs five lakhs.
 
Adv. Rodrigues has further stated that Adv. Amit Desai and Adv. Ashwin Bhobe with common intention conspired and dishonestly induced the State Government into paying the bills for appearances not made and falsely represented before the Government that the four appearances in Court were truly made. 
 
Adv. Rodrigues has sent to the Bar Council copies of all documents obtained by him under the Right to Information Act which establish that Adv. Amit Desai and Ashwin Bhobe had cheated the State Exchequer. .
 
Demanding action by the Bar Council against Advocate Amit Desai and Adv. Ashwin Bhobe,   Adv. Aires Rodrigues has stated that their conduct was a clear act of gross professional misconduct.

NEW DELHI: A defiant comptroller and auditor general on Tuesday rebutted claims that he had overruled his subordinates who put the loss from the 2G scam at just Rs 2,600 crore to project the figure of Rs 1.76 lakh crore. Vinod Rai emphasized that he had actually toned down an initial estimate that valued the loss to the exchequer at more than Rs 4 lakh crore.

Appearing before the joint parliamentary committee after his former colleague R P Singh told the panel that he did not subscribe to the estimate - one of the three arrived by CAG in its report - of Rs 1,76,000 crore loss, Rai strongly defended his report.

Rai, who took the unusual step of writing to PM Manmohan Singh after the latter criticized CAG for wading into policy issues and addressing press conferences, made it clear that he was not fazed by Congress's charges. He said the auditor faced similar criticism when it highlighted irregularities in the purchase of Bofors guns by a Congress regime or the conduct of Kargil war under the BJP-led NDA government.

Rai's reference to the May 2010 letter undercuts Congress's claim that CAG overruled R P Singh to jack up the 2G scam estimate to Rs 1.76 lakh crore. Rai said different estimates, ranging from Rs 48,000 crore to Rs 4.19 lakh crore, figured in the three-stage audit process CAG used to assess 2G scam loss.

"Several figures of loss ranging from Rs 2,645 crore to Rs 4.19 lakh crore were projected at different stages. Final decision is that of the CAG," Rai asserted.

Playing down criticism coming from the ruling party, Rai said CAG was always attacked when it came out with a hard-hitting report. "In the purchase of Bofors guns, the then CAG T N Chaturvedi and the government had difference of opinion in the year 1989," Rai said. This was repeated when CAG came out with its report on Operation Vijay. "There was major criticism of CAG by the executive. Such was the criticism that the then PAC chairman N D Tiwari had offered to resign on February 20, 2007 if the dignity of the office of the CAG could not be maintained," he pointed out.

"The audit department is obliged to say things which are embarrassing to the government but it is the duty of its officers, on account of their greater loyalty to the country, to act as a check even on the government," Rai told the JPC. He would always tell his officers "not to shrink from truth for fear of offending men in high places".

Shashi Tharoor recently argued in the cover story of Tehelka, "Shall we call the President?", that the Parliamentary system had outlived its utility and it is time for India to shift to a US-style Presidential system.

 

I have, in a rejoinder to Tharoor's article, argued in Governance Now, "In defence of our Temple of Democracy", that though Tharoor raises many issues regarding our present political system, the answer does not lie in abandoning the Parliamentary system but in reforming the same.

To simplify : 100 members of a housing soc appoint a society manager to look after maintenance and improvement of a soc. They give a hefty salary. Everyone contributes Rs 100 pm. So in a yr Rs 1.2 lacs are collected. But instead he spends only Rs 20K on soc and eats away Rs. 1lac. In few yrs what will be condition of soc??? Lift wont work. Water will not be pumped so scarcity. garden will dry.Common passages will be dirty and paan spits will be everywhere. Since watchman r not paid properly by this corrupt manager so good one run away and then he hires some goonds. So these goonds molest one of the daughter of soc, theft happens in few flats, they let illegal hawkers sit inside, they converrt area near gate gambling den ......and so on ...and finally your life in your own society is hell, unsafe, flat is not selling at good price so u r stuckup , etc etc.

But when u pass by he will give u a swift salute and u become happy. Actually one Kishansing gulped part of our property from my grandfather as he was entrusted to look after same as a manager. Similarly these bureaucrats and politicians have mercilessly looted and mishandled and mismanaged us yet we dont see their design. And they shout on Annaji and we believe these goons !!! A Story From Indian History Vikramaditya & Betal And Its Relationship With Current Events [Do not miss it] 

Once there lived an old and pious man, renowned for his honesty. One day his neighbour, a rich merchant comes to him with a request. The merchant was leaving on a voyage and wants the old man to safeguard his wealth, until his return. The old man agrees and with God as witness promises to protect and safeguard the merchant’s wealth.

The old man then entrusts the safe keep of the merchant’s wealth to his son, from whom he takes an oath of propriety  and honesty. Slowly the son starts dipping into the merchants wealth, people notice this and warn the old man of the
son’s misdeeds. The old man calls his son asks him to explain, he also reminds him of his oath on following the right path. The son rubbishes the accusations as rumours and the idle gossip of jealous people, who could not bear to see his prosperity. The old man accepts the son’s explanation and things go on as before.

The merchant returns and demands his wealth. The old man calls his son, who hands over a quarter of the merchant’swealth saying that is all there was
. The merchant realizing that he as been cheated approaches the King. The King listens to the merchant’s complaint and summons the old man. The old man comes to the court with his son and handing him over to the King says “your majesty, the merchant is right. My son has confessed to the crime. Please punish him.” The king has the son flogged and imprisoned. He then praises the old man's honesty and dismisses the case.

But the merchant demands punishment for the old man saying, “I have still not received justice. I had entrusted my
wealth to the old man, which he swore by God to safeguard. The old man’s integrity is intact, but what of me, I havebeen robbed of my life’s savings, and made a pauper. It was the old man’s decision to entrust my wealth to his sonfor safe keeping. As far as I am concerned the old man is the culprit, and should be punished.
 
The king is astounded by this demand. The old man was neither a party to the theft nor did he benefit from it. In fact, he  had sent his son to jail. Yet, the merchant was asking for the old man’s punishment.*

The Betal asks Vikramaditya, “What should be the Kings decision?”

Vikramaditya’s replies, “Though the old man is innocent of the actual theft, he is guilty of dereliction of duty. The son’s
crime was a straight forward one, the old man’s was a graver crime. He did nothing to protect the merchant’s wealth.

Far from being vigilant he failed to take action even when he was warned of his son’s misdeeds. Because of his laxity the merchant is condemned to a life of penury. He should be punished.”

India 2010, Dr. Manmohan Singh, esteemed economist, former Governor of RBI, Deputy Chairman of Planning Commission, former Finance Minister, a man whose personal ethics and integrity are unblemished, takes oath to protect and
safeguard the Nation and its assets. He appoints Raja, as his Cabinet Minister for IT & Telecom. Unlike the story, this heist of a precious national asset is carried out in full view of Dr. Manmohan Singh and his cabinet colleagues.

People across the country cry out at this outrage.

The Indian Constitution grants the Prime Minister absolute power in running the country. He is the head of the
Government and the Union Cabinet functions at his pleasure. As per the Transaction of Business Rules the Prime Minister has the unrestricted right to demand and get any file, any record from any Ministry.

Dr. ManMohan Singh could have at any time stopped this heist of a National asset, yet he chose to remain silent.

The Prime Minister’s failure to exercise his constitutional rights has caused irreparable loss to the Nation.
Dr. Singh did not profit personally from Raja’s shenanigans, but his failure to act, to honour the oath of office, to protect and safeguard the nation and its wealth is unforgivable. Like the old man, he has sacked Raja from his ministerial berth, but does his culpability end there? The people of India had entrusted their faith and the future of the Nation in Dr. Manmohan Singh, believing him to be a man of integrity and
honesty, and not to Raja. Does dismissing Raja absolve Dr. Singh or like the old man is he guilty of dereliction of duty and failure to safeguard the Nation and its citizens? And he deserve punishment!

What do you think? -----Who is behind all fraud that is happening for the last 60-years?Punish them soon or we will be left with nothing.
