Jaindi Kisero; I do not get it

 

Mr. Jaindi Kisero has put up a very academic and suspect
support for Hon Uhuru Kenyatta on the issue of the purchase of the Passat
vehicles for government officials in today’s issue of the Daily Nation.

 

I say academic and suspect because all of us Kenyans can
read and interpret the provisions of the Public Procurement Act. This Act came
into being because of such scandals. It was meant to forestall such like Uhuru
scandals as it opens up procurement to public scrutiny and openness. It calls
for
invitation of not less than three bidders in instances where procurements are
in excess of Kshs 1,000,000.00.

 

And here, we are not talking about Kshs 1m; we are talking
about Kshs 5Billion! Or better still, Kshs 5,000
Million.

 

Mr. Kisero avers that the principle is to allow for the
economies of scale and enjoy bulk purchase discounts. How? Can this not be
achieved through competitive bidding process? If you subject the process to
competition, will you not achieve economies of scale and enjoy bulk purchase
discounts? Still, the Passats were bought at figures far higher than the known
market rates, so, how did the government achieve bulk purchase discounts here?

 

Mr. Kisero supports the thinking behind going for a specific
make, model and colour. This is so pedestrian coming from someone we all
thought had competent knowledge on issues economic. Honestly, if you go for
competitive bidding, will the winning bidder fail to comply on the same if that
was the yardstick? Of course, it will be a specific model and make. Then they
can give you all the vehicles in the colour that you want. This kind of
argument, I would say with all confidence once more, is pedestrian and suspect.

 

If some minister wants to go to Majenjo in his official car,
will owning a Passat stop him/her if s/he has been doing the same using a
Mercedes. Again, this is not convincing coming from someone of Mr. Kisero’s
calibre.

 

The use of words can really confuse and especially if there
is ill motive. Mr. Kisero says that Migosi Uhuru must be supported for having
the guts to implement the boldest attempt ever to rein in on ostentation,
opulence and sickening conspicuous consumption among our leaders. I beg to
differ. Passat presents the kind of wastefulness that we can do without. And I
am talking from experience. The Passat consumes more fuel than all similar
range of vehicles in the market. Secondly, obtaining parts is not easy. It will
cost the government more in terms of maintenance as compared to the Mercedes
E-Class. Thirdly, Passat is not as hardy as we are being made to believe.

 

To confuse our thinking, Mr. Kisero engages us to
diversionary tactics. He goes ranting about what our MPs are given as soon as
they get into parliament. My, it does not for any single moment justify what
Uhuru has done. You are cleverly leading us astray and the worst part of it is
that you are doing it intentionally. Our eyes are on the antelope brother!

 

I will take you down memory lane just to refreshen you. Mr.
Uhuru Kenyatta was appointed the Minister for Local Government immediately
Kibaki was declared the winner in 2007. And when time came for nominating
Councilors, he chose not to follow the laid down provisions where Councilors
are nominated on the strength of the civic performance of their mother parties.
I bet as a renowned journalist, you have the facts.

 

Secondly, the moment he was posted to Treasury, he came up
with things he casually called adding errors. The beauty of it all is that he
was caught with his hands in the till and his mouth powdered. He could not
escape it. But, together with his friend, the one he has given the insurance
contracts for the ‘Uhuru Passats’, parliament gave them a reprieve.

 

Recently, he bought his own land for the benefit of
resettling IDPs. A very noble thing indeed, only that he is the Minister for
Finance and the land in question is his.

 

Before the dusts settles down, and with the government
telling all those who care to listen that they will conform to the rule of law,
your Uhuru is back in the news with this ‘Uhuru Passat’ issues.



It makes me ask, is this man serious? Is he intentional? Must he make all the
money now? And MUST Jaindi Kisero, Jaindi of all
people, must Jaindi defend him?

We have had many people coming into camps in open spaces and then calling
themselves Internally Displaced People. And I have looked at how our government
has handled this issue with dismay.

Recently, Mr. Uhuru Kenyatta bought his own land using government money for a
few Kikuyus who were claiming to be IDPs. As this was being done, we know that
there were many Kenyans, not just Kikuyus who were displaced.

Again, recently, the President went to a place Kikuyus christianed Kiambaa, in
the heart of Rift Valley to bury Kikuyus who were killed in the skimishes of
last year. Again, many Kenyans were killed in the clashes and the President was
never available to attend their burials.

Now, who are these IDPs who seem to be more special than all other Kenyans who
were affected?

Mr. Orinda Ndege lost his 2 wives and 9 children when his house was burnt in
Naivasha. Do we have any one else who suffered more than this man in Kenya? And
has the government made any single effort to help him?

We are living a lie. Kikuyus in power are pretending that there were no other
Kenyans who were affected. And Raila Odinga and his Luo team of MPs are behaving
as if Orinda Ndege deserves no help.

When Uhuru uses government money to buy his own land for Kikuyus who are
pretending to be IDPs, where are our leaders? From Nyanza, Western, Rift Valley,
Nairobi, Eastern, North Eastern and Coast? Are IDPs only from Central Province.

We are living a lie, and our leaders have been compromised to pretend that IDPs
were only Kikuyus.

In my usual character, I will not respond on the personal attacks, but

It has been a very long time in search of a new constitution. And with the
unveiling of the Harmonized Draft, it is now out turn to add value.

As we read and make comments, let us all agree that once passed, Parliament will
not make any amendments to it. They will pass it as so desired by the People of
Kenya.

If we pass the recall clause, and again subject the same to our MPs in
Parliament, be sure they will go and ammend it, in the process, they will remove
it.

We have all seen how our MPs behave with serious National Issues in Parliament
and I bet, if we subject the Final Draft open to Members of Parliament, they
will be bought and in the process, they will ruin our party.

       Friends,

I share in the plight of those who are moving out of Mau out of their own
volition. They are doing the right thing. They should not have gone into Mau in
the first place.

Secondly, I share more deeply in the plight of the so many Kenyans who have been
made to suffer immensely because of the greed of these few lot.

Several rivers went dry because of these few invaders. Our wildlife suffered
some more because of these few invaders. At one point, I wept when I saw Hippos
in the Mara River stuck in mud, with no water to cover their backs, courtesy of
these few invaders.

In Nairobi and several places, our taps have gone dry because of these few
invaders.

Again, we all know that power is being rationed because of these invaders. We
are paying higher tariffs because of these invaders.

As much as we might sympathize
  with their plight, I am more inclined to support the approach of Hon William
Ole Ntimama. He has been fighting a lone battle for almost 10 years. But now, we
have all seen what he has been seeing; the kind of destruction brought on our
water towers by these selfless invaders.

When their time was up, courtesy of brilliant journalism from the KTN
journalists, we were exposed to the Mau lie. These people are being used for
more selfish reasons. They are not content with the kind of destruction they
have visited on Kenya, they are still playing games. How selfish can one become?

Secondly, the media have been all over Mau, they never saw the number that you
are passing around as fact. This is some very fertile imagination from the very
architects of the Mau destruction. Having failed, not really failed, having
devoured the beauty of Mau, they now have their sights on our money; for
compensation.

We now need to compensate these few people
  for messing up with Mau and our lives.

I wish I was the President, and not all Kalenjins are this callous.

PRESS STATEMENT ON MAU EVICTIONS AT 680 HOTEL ON Nov.18, 2009

PREAMBLE:
 
We, members of Rift Valley Civil Society Network,
 

Working to empower communities socially and economically,
Aware of the impact of environmental degradation,
Committed to the protection and conservation of our environment
Supporting our Government’s effort to protect and conserve the Western Kenya
Water Towers,
Committed to truth and justice for all citizens of Kenya ,
Promoting sustainable peace and justice in Rift Valley and Kenya at large,
Respecting human rights and the rule of law by all citizens of Kenya ,
Working to alleviate suffering and restoration of human dignity among
communities,
Having assessed the Mau eviction situation,
 
Do hereby issue this press statement:
 
INTRODUCTION:
 
The Mau Evictions process started on Tuesday 10/11/09 following the expiry of
the 14 day quit notice by the Kenya Forest Service that ended on 9th.  The
targeted areas for eviction included Lelpanget, Kipkongor, Saptonok, Tiloluet,
Koilonget, Kipsengwet, Arorwet, Kusumek and Ndoinet. In preparation for the
evictions, the Government reportedly deployed over 300 armed security officers
and maintained that the evictions shall be peaceful and humane.
The settlers started moving out of their settlements on Tuesday 10/11/09 to
displacement Camps and highlighted by the media. This confirmed that these
settlers are peaceful and law abiding citizens.
On Friday 13th November 2009, a humanitarian mission was organized by Rift
Valley Civil Society Network spearheaded Emo Foundation and four other partners
namely Kenya Foundation for youth and Women, Kipsigis Heritage Foundation and
Kuresoi Kipsigis Council of Elders, accompanied by the media.
 
PURPOSE OF VISIT:
 
The purpose of the mission was to assess the humanitarian situation of the
evictees and see how to assist them.
 
OBJECTIVES:
 
·        To identify the locations that the evictees have camped
·        Determine the numbers and assess their humanitarian situation.
·        Identify and highlight their needs.
·        Appeal and plan for humanitarian intervention.
METHODOLOGY:
 
The mission interviewed among others the District Commissioner, Area MP, Elders
and evictees. The road conditions were very bad and we had to walk for some
distance to access the camps.
 
FINDINGS:
 
·        Evictees moved out peacefully. They heeded the Government’s
notice hence moved out and camped by the roadside.
·        Evictees camped in 10 areas namely:
o       Lelpanget -1600 people
o       Kipkongor -1400 people
o       Saptonok – 230 people
o       Kiptisia – 780 people
o       Tiloluet - 640 people
o       Koilonget - 482 people
o       Kipsengwet - 348 people
o       Aroruet - 560 people
o       Kusumek - 403 people
o       Ndoinet - 3560 people
Total population: 10,003 people
 
Humanitarian situation:
 
·        No shelter, only temporary sheds.
·        No food as the evictees had finished all they had.
·        Very poor hygiene situation as there were no toilet facilities
and water
·        No medical facilities and one child who got burnt could not
access medical care whereas several sick elderly persons and disabled left
behind in the abandoned homesteads at the mercy of marauding wild animals e.g
hyenas.
·        People were highly traumatized especially children and women.
·        People had left their crops in the fields and the evictees
complained that the security personnel had harvested their crops and took to
their base which the DC denied receiving any compliant. The area MP confirmed
receiving the information and raising it with the authorities concerned thus
ending the vice.
·        Education had been disrupted due to the evictions as children
flee with their families.
·        There was no humanitarian intervention four days since the
people arrived at the camp and the DC confirmed that plans were still underway
for logistical and relief intervention. It was clear that the Government had not
adequately prepared for the   entire exercise.
·        There was no humanitarian agencies in sight though the area MP
said he had approached Red Cross but were nowhere on site four days after the
exercise.
·        The evictees claimed that they camped because they did not have
land anywhere else to go.
 
Land issues:
 
The evictees claimed to be landless and had nowhere to go. They claimed to have
been sidelined in land allocation where powerful individuals including former
provincial administration and senior Government officials allocated themselves
large chunks of land at their expense thus pushing them to the forest. This was
quite visible as large trucks of large of land belonging to individuals were
widespread.
It was reported that a land in Molo formerly belonging to a former prominent
politician had been bought by the Government to settle them but was instead
secretly allocated to members of one community.
 
Impact on Peace and reconciliation:
 
The developments in Mau are raising tensions and likely to affect peace in the
area.  Utterances attributed to some leaders especially the Minister for
Forestry and Wildlife asking people to go to where they came from is a big blow
to peace gains so far achieved and national healing process.
 We therefore make the following statements:
 
Humanitarian:
 
We are appealing to the Government to speed up the relief assistance to the
evicted Mau settlers (GDP’s) Government displaced Persons, to reduce human
suffering.
We urge other humanitarian organizations and individuals of goodwill to come to
the aid of the Mau evictees.
 

Land issues:
 
We are asking the Government to speed up the resettlement of the evicted
squatters just like it is resettling IDPs and should not be seen to be
selective.
The Government cannot be trusted as a custodian of public land as its officials
and officers have allocated themselves large chunks of land instead of
squatters. It should therefore target powerful individuals who have
unscrupulously acquired land and revert it back to the forest.
 
Conservation of Mau:
 
The Government should make the communities in the region and especially the
youth to partner in conservation by enabling them to participate in the
rehabilitation of the degraded forest.
 
Peace and reconciliation:
 
The Government should promote peace and reconciliation by addressing the
resettlement issue fairly and promote national integration. The current
resettlement exercise clearly seems to target by not targeting only certain
communities for resettlement while persecuting others e.g. Govt. Displaced
Persons (GDPs), Ogiek, Siringonik, Embobut and Mt. Elgon .
The Government should come out clean on the allegation of allocating the land in
Molo to one community at the expense of genuine Mau squatters and take the
necessary actions.
We vehemently abhor irresponsible utterances by senior politicians and civil
servants alleging that people should go to where they came from which negate the

We all have heard of Mzee Orinda Ndege and how he suffered the most during the
clashes of early last year.



He lost his 2 wives and 9 children in one morning of madness.



Up till now, we only read and hear about him whenever mention is made of clash
victims, but we do nothing about it.



In March, a group of friends came together and enabled some of us to
visit Mzee at his home. We will be making such a visit again on 18th
December 2009.

Harmonized Draft a real time

I have taken my time to read the Harmonized Draft
Constitution of Kenya, and I can with all confidence urge Kenyans to reject it.
It is worse than the current Constitution.



 



In making this appeal, I have taken cognizance of the fact
that the problem all along has never been the Constitution; the problem has
been the Executive which has over the period
emasculated all powers to an extent that we have an imperial presidency, one
that even the Judiciary cow-tows to.



 



1] Chapter 4 Citizenship



At Article 19- Citizenship by
naturalization; A person who has been lawfully resident in Kenya for a
continuous period of at
least seven years, and who satisfies the conditions prescribed by an Act of
Parliament, may apply to be naturalized as a citizen.



 



This basically means that we may import Artur Sagasyan and
his brother, host them for seven years, naturalize them, and then activate them
for the intended reasons. It smells. Already, Kenya has been invaded by none
Kenyans who have made the cost of property to be out of reach for indigenous
Kenyans, and this Act will make Kenyans be subservient to foreigners, pirates
and charlatans.



 



2] Chapter 6 The Bill of Rights



The Bill of Rights is very utopian. It lists all the good
things then in one single fell swoop, curtails them all.



At Article 33 [1] No right or
fundamental freedom set out in the Bill of Rights may be limited except-



(a)   
by a limitation or
qualification expressly set out in the provision containing that right or
fundamental freedom or by law;



The usage of the two words, ‘by
law’, curtails all the beautiful provisions as set out in the entire
Bill of Rights. It basically means that your fundamental rights are abrogated
herein.



 



Again, at Article 76, Human Rights
and Gender Commission is being entrenched in the Constitution. I bet
this is wrong. A Commission can be effected through a mere Act of Parliament
not by entrenchment of the same in the Constitution.



 



3] Chapter 10 Representation of the
People



Article 110- Electoral disputes-
[1] An Act of Parliament shall establish mechanisms for settling electoral
disputes.



Honestly, Kenya
almost went to the dogs due to an electoral dispute last year and now that we
have a chance to fix the problem, we are shying away from the same. Instead, we
are entrenching things like Human Rights and Gender Commission into the
Constitution instead of being clear on how we will fix electoral frauds.



 



On the Independent Electoral and Boundaries Commission, the
Harmonized Draft does not come out clearly. It gives a loophole through which
there can be manipulations. Look at this;



 



Article 112 [4] The Commission
shall exercise its powers and perform its function in accordance with this
Constitution and national legislation.



We do not need any national legislation here. We need the
Constitution to be very clear on this. This ambiguity is what has made Kenya
gain in several new Districts in the last 4 years.



 



Chapter 11- The Legislature



This has been badly drafted. It segregates against Kenyans,
men in particular. Why must we give women special seats and at the same time,
allow them to compete fairly with all. Article 126 [1]
is a classic example of how not to do it. We need to be very clear on what we
want, how many members of either the Senate or Parliament and subject the same
to Universal Suffrage. It makes nonsense of gender equality. We must then
accept the status of women as being otherwise less in stature to men, to the
extent of being equated to children, disabled persons, and minorities despite
their numbers as recorded in the last Census.



 



Article 131 [2] Parliament shall
enact legislature to provide for the grounds on which a member may be recalled
and the procedure to be followed.



This should have been very clear. But leaving it at the
mercy of the same people to be affected by the recall, is slightly being
disingenuous,
playing roulette, telling us that it shall not be done.



 



Chapter 12- The Executive



I am now more convinced than ever before that all those MPs
who are talking about the powers of the President being reduced and given to
the Prime Minister have not read this Harmonized Draft. The Draft makes the
Presidency more imperial than ever before. Have a look at this;



Article 158 [2] The State
President, in accordance with this Constitution and the law, shall appoint and
may dismiss-



(a)   
the Cabinet, including
the Prime Minister, the Deputy Prime Minister and the Ministers…….



Look, he does not need to have any reference anywhere. What
do you make of the Constitution that gives the President such sweeping powers?
Then it goes further to give the President all those powers to appoint all and
sundry, and you want to call it weak? Article 158
takes us back to the pre-Section 2[a] days. And we must not pretend here, we
are creating a dictator here, an imperial President to boot.



 



Articles 179 and 180 proves
how week the office of the Prime Minister shall become. And at Article 180 [1]
(a) and (b), you see the kind of
manipulation that waters down the office of the Prime Minister. It basically
reduces the stature of the same office because the State President can appoint
anybody to that office, not necessarily the person with the largest number of
Members of Parliament.



 



Chapter 13- Judiciary



I bet all courts of law are meant to uphold the rule of law,
so, why do we have classification of courts? Why have a Constitutional Court?
And then make it
that draconian as to limit our Fundamental Rights- Article
203 [9] All decisions of the Constitutional Court in matters relating to
elections are final.



 



This is dictatorial and cleverly meant to subjugate the rule
of law. This Court will be parked by Executive Apologists who will be switched
on
as desired for the desired results. The moment they lock you out, even in
direct contravention of the law, you are left with no more avenue to seek
solace. This basically abrogates our Fundamental Human Rights.



 



Chapter 14 deals with Devolved
Government, and as it is now, we already have too much government in our
lives. This new Draft takes it to our doorsteps. It is giving us no breathing
space. It will even curtail our parking rights, to an extent that the
Government will tax you for parking your car in your compound, because they
must generate revenue to maintain this monolith of a Government that has been
proposed.



 



I bet we need less government in our lives.



 



I am not a lawyer yet I can pin point these inconsistencies.
I bet Kenyans ought to reject this Draft, come back to reality and demand that
the law as we currently have it, must be obeyed. We cannot have a government
that does not respect the law of the land. That has been our problem, not the
lack of good laws.



 



Can we start by respecting the law as it exists? The bottom
line; the current Constitution looks better than this thing that has been
cooked by many cooks.

and the Mau saga
The Mau Saga is taking a life of its
own and two things stand out very clear;

The Government Resolve is wanting. I
have put resolve with a capital ‘R’ because, the Government is
not Raila Odinga alone.




The line ministries that are supposed
to be leading from the frontline are those of Environment and Mineral
Resources, and Forestry and Wildlife Services. We are seeing very
lukewarm support from the Ministry of Environment and Mineral
Resources yet we all know how aggressive the Minister is. He is one
man who moves with some passion on what the government has made
decisions on. From the Ministry of Forestry and Wildlife Services,
the Minister is coming in a manner that raises his capacity.



Secondly, we are all witnessing the
aggressive approach being mounted by Hon William Ruto and Team Ruto.
Their arrogance in dismissing government policy is again aimed at one
person; Raila Odinga. And this again begs the question; is Raila
Odinga the government?



In the two scenarios, one would want to
ask, where does the CEO fall? Is the CEO complicit to Michuki’s low
key approach this time around? Is the CEO complicit to lack of
capacity from Dr Noah Wekesa? Is the CEO complicit to the bravery
with which Ruto and Team Ruto is attacking the person of Raila
Odinga? Is the CEO part of this scheme in the unfolding Mau Saga? Has
the CEO found in Ruto an able and capable person who can be used to
fight Raila?



I was waiting to look at how our
political commentators would tackle this issue this weekend, and
sadly, they have all gone conventional and refused to address the
hard facts. The Mau Saga fundraising offered us some good insights
into what is going on and I want to join the Rt Hon Prime Minister in
saying that these people are shedding crocodile tears over Mau. They
have no interest with Mau, nor do they feel for those people who are
leaving Mau. They have all hatred for one; Raila Amolo Odinga. And to
them, it is pay back time, ably supported by the CEO.



The Mau Saga has just given these
people the platform through which they can attack Raila using the
names of the people. They do not have any feelings for the people,
for they created Mau, so how can they have feelings?



It is worth noting that in that
gathering at the Panafric Hotel, we had leaders who are filthy
wealthy; yet, they cannot honestly justify how they became such
wealthy. Hon William Ruto is not known to have worked for a decent
pay at any place since he came from the University. He worked for 6
months as an untrained teacher, then joined Hon Cyrus Jirongo and
others to form the infamous Youth for Kanu 92.



Kenyans know how this outfit ruined our
economy.




Then Ruto emerged from it as one
wealthy boy who had the capacity to vie for the Eldoret North
parliamentary seat. The rest has been history; one scandal after the
other and he grows rich by the day. Now, he is man enough to dare all
Kenyans on the emotive Mau issue, using the victims as pawn in his
power game designs.



But all said and done, can Ruto have
the kind of courage he is showing if there in no hidden hand in his
design? I doubt it. Can Ruto take on the Prime Minister in such a
crude fashion if he is not covered? I again doubt it?



Time has come for Kenyans to look
deeper into this problem. Why is the CEO enjoying as the Rt Hon Prime
Minister is being hit below the belt? How come the CEO has never come
out in open support of the Prime Minister at these trying moments? Is
the CEO part of this design to once and for all finish Raila? And
will they succeed this time around?



The answer to these questions came
immediately after the Panafric Mau Harambee meet. Jimmy Kibaki
visited Rift Valley and told his audience that the Ruto schemes have
the blessings of the CEO. We knew he was going to deny that, but the
good thing is that it had come out. He has since denied what he was
caught on camera saying.



The second picture that complicates
matters for the CEO is Michuki’s lukewarm support for the Mau
evictions despite being an environmental issue directly affecting his
ministry. We all know Michuki and how forthright he is normally. He
would in his holy righteousness tell us what they discuss with the
CEO. His silence and none action is telling us just that.



The third sign was Hon Kiraitu’s body
language and mannerisms at the Panafric Mau Harambee. Some things
need no further readings.



The last sign is the silence emanating
from the CEO himself. The Prime Minister is being bashed for
implementing Government decision and he keeps quiet. It speaks
volumes.



I was once at home and one of my uncles
asked me about the CEO. I said I do not know anything about him, he
is so silent. My uncle told me, the man is so silent by the day, but
at night, he talks throughout.




I believe him now. They talk about
Raila Odinga throughout the night. And Kenyans are watching.

The attention of the nation is now firmly
riveted on the new draft constitution of our country. But we can not get away
complaining, as we have to bear this formality of the launch of Nairobi East
Business Association.

 

It is not for the sake of mere
formality that we have assembled here. A journey of 1000 miles begins with the
first step. Equally it must be remembered that not every launch is associated
with pomp and fanfare….many large corporate have grown from very humble
beginnings! So I wish NEBA a bright and successful future and God’s choicest
blessings.

 

I have always believed that the key
for social development lies in social transformation first. It is sheer
coincidence that I interacted with Oketch and we shared similar ideological
thoughts. We shared ideas on how to engage youths in community projects for
economic empowerment. The country has a vibrant youth population that is
waiting for opportunities and rearing to go. The opportunities for social
development have to be created at grass roots by giving the youth a platform.
That
platform can be created through public private partnership dialogue.

 

I am happy to learn that Komarock
Community Development Network has already embarked on environmental
conservation and improvements such as canal cleaning. It has also taken up the
challenge for a Model Satellite Estate in Africa
in pursuit of Safer Cities Initiative where the environmental and security
needs of the residents are factored in. These initiatives will make Kenyans
proud, more so because Nairobi
is home to Habitat and United Nations Environment Program – UNEP.

 

There are many innovative projects Komarock
Community Development Network and Nairobi East Business Association can
undertake. I am aware that some are in the pipeline already, some are being
undertaken but let me elaborate for those from the audience who are not
introduced to the concepts of the projects.

 

·          
The issue of environmental
conservation by the youth is the most laudable proposition. Let us have clean
environment, green environment and healthy environment and recapture the title:
“The green city under the sun”. Today the City Council of Nairobi
is lacking capacity for cleaning the sidewalks / footpaths and levelling them.
There are also open spaces and river banks that need regular cleaning and
constant improvements. Building partnership with CCN for environmental upkeep
is the first step towards social transformation.

 

·          
One can only turn to beautification
once space around the neighbour-hood is clean, neat and trim. There will be a
positive
change of attitude in the residents, in a cheerful and healthy atmosphere.

 

·          
City Council of Nairobi has long resigned from the task of garbage
collection and disposal. But garbage dump sites are the proven source of power
generation. Only yesterday it was highlighted in the press of its immense
potential. This project is capital intensive and highly technical but the
community youth have an opportunity in recycling glass bottles, plastic wares,
metal articles etc. Even manure can be harvested from bio degradable waste such
as vegetable off cuts and left over food.

 

·          
One of the greatest challenges to
safer city is insecurity. Like City Council of Nairobi, the police force has
failed to curb this menace. Community policing is the only answer to reduce
crime and improve security. Community policing is not the preserve of
corporate. The social responsibility to provide security lies with every
individual, every family. The socio-economic transformation takes place with a
safer and secure environment.

 

·          
Today, the youth lack the opportunity
to acquire skills necessary for gainful employment. There is an urgent need for
vocational training. With the current size of the population of the city of
Nairobi, we must open more
technical training institutes to enable youth in improving technical skills.

 

·          
The technical skills, such as
plumbing, electrical, carpentry, welding, painting etc. help a person to set up
small scale businesses which complement industries and promote entrepreneurship.

 

·          
In social transformation, advocacy
plays a critical role. The advocacy has many advantages of promoting family and
moral values, religious education, the effects of HIV-aids on the families and
even the benefits of water harvesting.

 

·          
And finally, I seek your support for
the Child Alive campaign. This is a Unicef program to help an African child
undertaken jointly with religious organisations. Funds are raised by sending
out messages from your mobile phones, and they are used to sensitise the
general population on the importance of post natal care, nutrition, hygiene and
sanitation, immunisation etc.

 

All the above examples show that a
small initiative can match the strides of large corporate in terms of vision
and mission. It is possible to bring about a change by people’s
initiative.

 

We want the community to embrace
positive civilisation values. The civilisation can not exist without the
residents and the civilisation can not thrive and flourish without moral and
family values. These are two faces of the same coin. So we must promote and
enhance civic responsibility, education and action leading to a better Nairobi
East community

 

While I wish to congratulate
Odhiambo Oketch and his team for the launch of Nairobi East Business
Association, I can assure the support of Hindu Council of Kenya which is
an umbrella body of over 150 institutions and 5 branches in Kenya. As a
representative body of
60,000 Hindus in Kenya,
it has participated in the inter-religious, social and political fora in the
country.

 

HCK is a key
stakeholder of the faith based organisations in Kenya and a strong voice of the
Hindu population. HCK through its member institutions has over 100 years of
legacy in diverse sectors of the Kenyan society – a legacy of bringing
communities together for national cohesion and to alleviate poverty. This we
have achieved through our traditional and religious value systems.

 

We can assure the residents of
Nairobi East of our support for this noble cause when we see in this initiative
desire, commitment and drive.

 

And let us remember that it is not
in the hands GO/NGOs to transform but in the hands of every one of you. You
will need each other’s support to facilitate in our journey.

He is doing The Daily Nation a dis-service by only targeting Raila all the
times. It is said that simple minds discuss people and that is where Ngunyi
is--- Very Firmly-- a very simple mind.

He is adding no value to the quest that Kenya needs.

If I were you, I would ignore him and move on.

       Odhis, I will respond. But one thing is certain, he is driving people away

* The Raila-Ruto ‘catfight’ has its owners. The latter is a mere hangman
This week did not make sense to me. Kofi Annan arrived on an irrelevant mission.
And then he said nothing new. All he did was whine about a local tribunal. And
on this, the man does not get it. We have said no to a local tribunal. Period.

But if he is unhappy with us, he is free to set up a “local tribunal” for
Kenya in “Kumasi” or wherever he comes from. It is that simple. Then there
was the constitutional review debate. This one is dying. For some reason, it did
not even pick. It has no oomph, no energy! And I blame the lethargy on the draft
constitution.

It has no legs; no future. But in the razzmatazz of the week, two things stood
out. One, the Raila-Ruto “cat fight”. Two, the looming shadow of
Moreno-Ocampo and his expected announcement before Christmas. If the week was
confused, it is because of the two things. And, in my view, they are related.
Allow me to explain.

Raila Odinga is a slow-punctured revolutionary. And the tragedy is this: He is
in denial. But on this, I do not blame him. The brother is keeping it real!
As the Chinese say: “… if you want to shrink something, you must first
expand it. If you want to get rid of something, you must first allow it to
flourish”. This is the “Odinga tragedy”.

As Prime Minister, he is ‘‘expanding’’ and flourishing. Unfortunately,
he has become a balloon. Bloated, flighty and full of air. Soon, he will be
popped. And, in my view, this is deliberate.
Even in the Holy Bible, they fattened a lamb. The fat lamb believed it was the
best until they sacrificed it. The ancient tribes did the same. They looked for
the finest human being. Then they fed him, oiled him and elevated his ego. And
when the time was ripe, they offered him to the gods.

Like in ancient times, Mr Odinga is being fattened. The tragedy is that he is
enjoying the “fattening”. Soon, they will present him to the “gods” as a
sacrifice.
And William Ruto will be the happy “High Priest” to perform the ceremony. In
sum, the Raila-Ruto “cat fight” has its owners. Mr Ruto is just a front; a
mere hangman.

But if this is true, who are the owners of this ‘‘fight’’? There are two
layers of owners. The first is vicious, the second is cautious. The vicious
layer has nothing to lose “except its chains”.
This is the group mentioned in the Kenya National Commission on Human Rights
report. On this list we have Mr Uhuru Kenyatta, Mr William Ruto and Mr Najib
Balala.

If Mr Moreno Ocampo relied on this report, the three have reason to panic. And
in panic, it is only reasonable for them to form a “brotherhood” of sorts.
The “Mau rebellion” is therefore an excuse; a platform that brings them
together.

Unfortunately, Mr Odinga is in denial. He cannot read the ploy. Yet in the
scheme of things, he is the target; the fat sacrificial lamb to be offered to
the political “gods”. But why do I say so? I have two reasons.
One, he is seen as a traitor by the Kalenjin Nation. If they fought in 2008, it
was because of him.

But when Moreno Ocampo came to town, he disowned them. And for this, they can no
longer call him “Mibei”. The fond nickname is no more. In fact, the fallout
between him and the Kalenjin Nation is total.
Now they must send him to the gallows. And their hangman is Mr Ruto. The second
reason involves others: those afraid of the “Ocampo process”. Their options
are few.

To buy time, they must destabilise the coalition government without collapsing
it. And the best way to do this is to bring Mr Odinga down. The tool for doing
so is a vote of no confidence in the Prime Minister.
This vote requires 112 MPs. If the Mau harambee could summon 56 MPs overnight,
it can double the figure in a month or so.

But what does such a vote mean? Would it collapse the government? Would it lead
to an election? Zero! The option for a snap election was removed. It is not in
the Accord; not in the constitution. If the coalition government collapses,
President Kibaki takes it all. No election; no contest.

Similarly, if Mr Odinga is removed, ODM would have to look for a new party
leader. Constitutionally, the new leader would be appointed Prime Minister. And
if they fail to get a new leader, the President can decide to do without a Prime
Minister. After all, Mr Moi operated without a Vice-President for eight months.
In sum, if Mr Odinga is sacrificed, the country would move on!

Let us consider the second layer now. In this group we have everyone Mr Odinga
has betrayed. And when you summon the evidence, he has betrayed almost everyone.
In political science, we love such people. In real life, however, they get
killed; sacrificed to the “gods”.

Beginning with the president, he would love to sacrifice this man. If he was not
a decent man, he would support a vote of no confidence in the PM. This would
declare him the “winner” of the 2007 election rather late. It would bring an
end to power sharing constitutionally.

The vice-president would support this to settle an old score. Mr Odinga betrayed
him when he decided to run for president in 2007. As for Mr Kenyatta, the Prime
Minister is a foe. He betrayed him in 2002 when he left Kanu to join the Rainbow
Coalition. If he had not done so, Mr Kenyatta would be president today. The
wounds of Mr Ruto and the Rift Valley MPs are still fresh. Their betrayal is
“now”!

They would support such a move. And the question to the prime minister therefore
is this: where are your troops? My reading is this: He has none. If this is
true, he is being fattened as a sacrificial lamb. Like a good sacrifice, the
sins of the post- election violence will be forgiven if we sacrifice him. This
is why he must be afraid. Very afraid!

Today it is the Ministry of Education. As we write this, Ministry of Agriculture
is on the spot of Maize scandal of Kshs 24B according to the World Bank [to the
extent that Kenyans are buying maize at the highest price anywhere in the
world].

Yesterday, it was the Ministry of Finance with figures intentionally not adding
up. If not, it is the Ministry of Internal Security with Defense procurement
that cannot stand any audit tests. Or, it is money for Kazi kwa Vijana going to
Wazee instead... And the scandals are everywhere, in almost all ministries.

That is how the government runs, and soon, a Commission will be formed, just
like we have witnessed several times. Do not mind that we were told that
corruption will cease to be a way of life in Kenya. History confirms the
reverse.

We had the Goldenberg Commission, the Anglo Leasing Commission, The Ndungu
Commissions, and several other Commissions that time has conveniently shielded
from our memory. And the results have been the same; no action.

Yet, cases where we have had arrests, prosecution and judgement that nails a
culprit, powers of mercy on the presidential clemency have come to play;
remember Ms Margaret Gachara?

Yet, the perpetrators of those major scandals are now regrouping and saying that
they want to ensure that their unholy union is the last revolution that will
bring good governance to Kenya! That they want to save us from their scandals!

I really get sick with this. But I am happy that I am not alone. We are many who
will not take this cabal of scandal inventing team as our saviors from the rot
that they occasioned on us.

Or, given that these are their scandals, they know how best to bring them to an
end?

I really doubt.

PRESS STATEMENT

Why Heads Must Roll
at the Ministry of Education

 

The scandal of looting education funds is a disgrace to Kenyans
and the world! It is an abomination for anyone to help themselves to the
baby’s
food in any culture. Moreover, the place of education in society as a social
equaliser cannot be gainsaid. It is a critical tool for lifting the masses out
of poverty, leading to equality and development,
which are the most common goals pursued by any responsible government in the
world. Education is the means through which any country’s foundations and
future are built.

Kenyans are utterly shocked at the ravenous greed recently
exposed in the inordinate and gross misuse and abuse of public funds,
regardless of concern for the future of Kenyan children and that of the nation.
The inefficiency and ineptness of overall administration and management in the
Ministry of Education and its agencies is abhorring and unacceptable in modern
times and age. The serious lack of accountability, transparency and
responsibility
in the management of funds in a programme aimed at ensuring that Kenyan
children, especially those from poor families, access basic education is
criminal.

The extent of the pillage shows a total failure of administrative
authority and lack of concern for the education needs of the nation. Clearly
government affairs were not conducted according to laid down processes and law.
Supervision organs at all levels failed in their oversight on how ministry
departments and individuals exercised their powers, performed their duties, and
on whether they strictly followed working procedures. Supervision organs failed
to carry out their role of control and appear to have been complicit in the
outrageous plunder.

The abomination
stinks to high heaven when we factor in the fact that the thieves belong to a
class that usually patronises private academies meaning, that unlike the poor
who depend entirely on the programme for the education of their children, they
do not need the Free Primary Education project.

Kenyans will NOT
and must NOT allow anybody to play with the future of our children and country.
The officials in charge of discipline supervision, including Education Minister
Prof. Sam Ongeri and Permanent Secretary Prof. Karega Mutahi, who failed to
spot and stop the wrongdoing must, therefore, be dealt with for dereliction of
duty. Prof. Ongeri and Prof Mutahi must lead the pack in resigning to
facilitate thorough investigations, especially if they believe that their hands
are clean. President Kibaki should sack them with immediate effect, should they
fail to resign. 

We are alarmed
that nobody has been arrested, nor recorded statements with the police. To
assuage public concerns on the management of public funds decisive action is
required in this matter. The anti-corruption campaign must become high-handed.
There must be visible fierce bites from the President rather than his usual
loud barks. President Kibaki must make an example of this case
by acting in a resolute manner that will leave no doubts in our minds that we
can rely on him to combat corruption, and to build a clean government, that
will provide a solid guarantee for economic development and the realization of
social justice.

We reject, as empty pious rhetoric, his recent order that the matter be
investigated. Year
in, year out, ever since he assumed office, the President has said the same
thing but taken no or negligible action whenever such scandals are
unearthed.  And year in year out new
scandals read like they were copy-pasted from earlier ones with minor
variations and adjustments. It is no wonder that many audit reports on these
scandals seem to have become valuable guidebooks on how to steal taxpayers'
money and get away with.

The misuse and
abuse of public funds is an act of treason against the Republic, and its
people. The inefficiency and ineptness of government administration and
management of public finances is also treachery. Time has
come when we must upgrade the looting of public coffers to the status of other
very serious crimes like treason and treat it as such. We must stop
punishing backyard chicken thieves harsher than we do
plunderers of public funds, whose actions kill many, and deny many more an
opportunity for leading quality lives.

Corruption
is a heinous crime and betrayal of Kenyan society. We cannot continue to treat
those facing corruption charges, those who have stolen billions of tax-payers
money, more leniently than we do petty chicken thieves. To do so demoralises
law-abiding citizens who obediently pay their taxes and see the money wasted
through open plunder.  Corruption harms democracy and social justice; it
disturbs rule of law
and hampers economic development; it is one of humankind’s worst enemies.

As
a matter of urgent necessity, we demand that those implicated in the looting of
FPE funds must refund all the money they stole, and be subjected to the
sternest punishment the law accords such a crime. Criminals MUST face the law
with little mercy accorded to them. Those who betray public trust by engaging
in corruption, by raping the nation, don't deserve to be spared the appropriate
punishment. Every effort must be made to ensure that
we rid our government of corruption. We say this because a government by
corrupt elements, by thieves, no matter how intelligent and efficient they may
be in other respects, is just as dangerous as a government by a foreign
occupation army of looters.

Accordingly,
in the spirit of our National Anthem, we call upon all Kenyans to defend our
country against these saboteurs. We must stand up for our children and for our
future.

kusimamia fedha hizo za kuhakikisha watoto wa Kenya hasa kutoka familia maskini

Uporaji wa ahli ya juu ni ishara ya
wasimamizi kushindwa na kutojali mahitaji ya elimu ya Taifa. Ni dhahiri kuwa
masuala ya serikali hayakutekelezwa kuambatana na taratibu rasmi na sheria.
Vyombo vya usimamizi katika viwango vyote havikuendeleza wajibu wake ipasavyo.
Vyombo vya usimamizi vilipuuza wajibu wao na kuonekana kushiriki katika uporaji
huo.

kumaanisha wao si maskini wanaotegemea mpango wa elimu bila malipo.

Wakenya HAWATAKUBALI na HAWAPASWI kukubali
yeyote kucheza na hatima ya watoto wetu na Taifa letu. Maafisa wasimamizi
wanaohusika akiwemo Waziri wa Elimu Profesa Sam Ongeri na Katibu Mkuu Profesa
Karega Mutahi, waliokosa kutambua na kukomesha uhalifu huo, wanastahili
kuadhibiwa, kwa kupuuza wajibu wao. Muhimu ni Prof Ongeri na Prof Mutahi
kuongoza kundi hilo
kujiuzulu ili kutoa nafasi kwa uchunguzi, ikiwa wanaamini hawana hatia. na Rais
Kibaki awafute kazi mara moja iwapo watakaidi pendekezo hili.

Tuna hofu kuwa kufikia sasa hakuna ambaye
amekamatwa wala kuandikisha taarifa kwa polisi.
Ili kudumisha imani ya wananchi kuhusu usimamizi wa mali ya umma, uamuzi thabiti
unatakikana kuchukuliwa. Kampeni za kupambana na ufisadi zinoe makali. Rais
achukue hatua badala ya mtindo wake wa kubweka tu. Rais anatakikana kuonyesha
mfano kwa kuchukua hatua ya kuwafanya wananchi kuamini wanaweza kumtegemea
kudhibiti ufisadi na kujenga serikali safi
itakayothibitisha ustawi wa uchumi na haki katika jamii.

Tunakataa matamashi yake matupu ya juzi kuwa
kashfa hiyo itachunguzwa. Tangu achukue mamlaka, Rais amesema yale yale lakini
hakuna hatua au hatua duni imechukuliwa kashfa kama
hizi zikifichuliwa. Kila mwaka kashfa nyingi zinazokaribiana na za awali
zinaibuka. Haishangazi kuwa ripoti zozote kuhusiana na hizo kashfa zinaelekea
kuwa miongozo ya kuiba mali ya umma bila
kukamatwa.

Visa vya ufujaji na matumizi mabaya ya pesa
za umma ni kitendo cha uhaini dhidi ya Jamhuri na wananchi wake. Tena, utendaji
kazi duni na ulegevu wa utawala wa serikali na usimamizi wa pesa za umma pia
una kasoro. Wakati umewadia wa kuweka uporaji wa mali
ya umma katika kundi moja na makosa mengine makubwa kama
uhaini. Tunapaswa kukoma kuwapa hukumu kali wezi
wa kuku kuliko waporaji wa hazina za umma, ambao mienendo yao
inaua wengi na kuwanyima zaidi nafsi ya kuboresha maisha yao .

Ufisadi ni kosa la
uhaini na usaliti kwa jamii ya Wakenya. Hatuwezi kuendelea kuwapa adhabu ndogo
wanaoiba mabilioni ya pesa za walipa ushuru. kuliko wezii wa kuku. Kufanya
hivyo kunawavunja moyo wananchi wanaojitolea kulipa ushuru na kushuhudia pesa
zao zikiporwa hadharani. Ufisadi unaumiza demokrasia na haki katika jamii,
unaathiri utawala na kutatiza ustawi wa uchumi. Ni miongoni mwa adui wakuu wa
binadamu.

Tunataka wote
waliotajwa katika uporaji wa hazina ya mpango wa elimu ya msingi bila malipo
kuchukuliwa hatua kali, haraka iwezekanavyo, kuambatana na sheria. Wahalifu
LAZIMA wafikishwe mbele ya sheria bila huruma. Wanaosaliti imani ya wananchi
kwa kujihusisha katika ufisadi, kwa kupora nchi, hawastahili msamaha. Kila
jitihada zinatakikana kutekelezwa kuhakikisha ufisadi serikalini unaangamizwa.
Tunasema hili kwa kuwa  serikali yenye wafisadi, yenye wezi, bila kujali
ikiwa wao ni watalamu katika nyanja zingine, ni hatari na inafanana na jeshi la
kigeni linalotuibia.



Hivyo, kwa mwito
wa Wimbo wa Taifa, tunawaomba Wakenya wote tujitokeze kuilinda nchi yetu kwa
kuwapinga vita hawa waslaiti. Lazima tuipiganie watoto wetu na hatima yetu.

Hundreds of kenyan's abroad have been returning home to celebrate this
years xmas with their families.most of the are coming from the UK and
US.Its said that travel in this season was comperatively cheap that any
other xams....flight to JKIA from Heathrow have been cut by major
airlines hence more Kenyan's could have afford flight back home

BREAKING NEWS!!!

Bunge la Mwananchi's George Nyongesa, Okiya Omtatah and 30 others, mostly women,
have just been arrested and taken to Central Police Station a few moments ago.

They were part of a demonstration organised today to protest the
misappropriation of free primary education funds and protest against the planned
compensation of people who own large tracts of land in the Mau Forest. The
demonstators had duly notified the police of the planned demonstration which was
to culminate in serving a petition from grassroot wananchi on the President and
the Prime Minister expressing strong public sentiment on these two pertinent
issues. The group was demanding the resignation of the Education Minister and
the Permanent Secretary and protesting the planned spending of public funds
towards compensating individuals who are holding land in the Mau Forest.

We will continue to keep you updated. However, we encourage you to join us in
protesting against the culture of impunity in Kenya. Do come to the Central
Police Station and support us in making the voice of the grassroot Kenyan heard
on these important national issues.
