I have an unusual question but of which I can find no help or advice on.
The Bridge recently applied for our 501(c)(3) status and were told that
we can obtain a 501(c) (4) or 501(c)(7)...but we need to re-apply and
the due date is December 27th. They said we didn't qualify for a
501(c)(3) based on the %`s of time spent offering a vast array of
"Educational" programs versus "Social" programs. I was confused with %`s
of time because we do this when asked to speak, table at events, etc.
What are the basic differences between these 501`s and a 501(c)(3)? I
can send a peer what we presented to the IRS and how/why they came to
this determination for a peer review, if anyone wishes to volunteer a
quick review and personal comments/advice. I was told by a person in the
IRS office Monday via US Post, this that "We don't qualify as an
"Educational" program" -501(c)(3) organization (what?!) but " the
other two 501`s might be a more fitting description of what our
organization does". I disagree as we are trying to establish
community centers which will offer all the programs and services we
currently offer, perhaps far beyond all we currently do. Indeed, all
other LGBT (or not) community centers across NY are all are 501(c)(3)
organizations! Why not The Bridge?!
We are now, as-we-speak, looking at two substantial grants amounting to
$50,000.00 to be released in March 2010. Our goal is to establish a
community center with our own building, for lesbian, gay, bisexual, and
transgender (LGBT) people in our small upstate NY city. We are so close,
yet now again we are facing another hurdle (& potential road block) in
our attempt to establish a community center.
For over 31/2 years we have offered numerous educational programs all
over NYS and various social activities/programs and now this! My real
concern is, are all 501`s basically the same when funding, which comes
through the LGBT Health & Human Services Network, and all grants are
awarded to those organizations who possess a 501(c)(3). I'm now in a
bind as to how we should proceed. Should we re-apply for our 501(c)(3)
and re-state our % of time spent on "Education" as opposed to "Social"
programs? I'm at a loss and don't know quite what to do and how
to proceed. We operate out of available churches, speak at conferences,
have an educational program which I have personally taught for two years
running, (a Transgender-101 course) at our local community college and
more. Our State Senator and Assemblywoman both gave The Bridge Letters
of Support. On behalf of The Bridge, I travel across NYS offering
educational programs by invitation. What else can we do without money?!
So much work and now this...could it be a prejudicial slant on this
review? I'd like to think not.
Our "Contact" person who did the review of our original application will
not return any of our phone calls (isn't she supposed to accept or
return our calls asking to clarify this?). This isn't something we
can pay to have done, but perhaps somebody in our Group can lead me in
the right direction. Your advice will be greatly appreciated! I can send
the original application and the response from the IRS to help you
evaluate where we're at right now and help me clarify if we can
still obtain grants meant for 501(c)(3) organizations with another
501(c) whatever.

Hi,
If the U.S. Federal Emergency Management Agency (FEMA) was a nonprofit
organization it would be defunded and debarred in a millisecond. They do not
even know what they do not know. Hurricanes Katrina and Rita ripped the Gulf
Coast of the United States in September 2005. The Katrina preliminary damage
estimates were well in excess of $100 billion. Because of Katrina 80% of the New
Orleans became flooded as well as large tracts of neighboring parishes. At least
1,836 people lost their lives in the actual hurricane and in the subsequent
floods, making it the deadliest U.S. hurricane since 1928. Katrina is the
largest natural disaster in the history of the United States. Rita caused $11.3
billion in damage. Rita caused extensive damage along the Louisiana and extreme
southeastern Texas coasts and destroyed some coastal communities. The storm
killed seven people directly; many others died in evacuations and from indirect
effects. New Orleans was working on reopening on September 19 but Rita hit and
caused re-evacuation of people on the 21st,, severe damage to the Ninth Ward and
breached rebuilt levees. Parts of Texas, South Florida, Arkansas, Mississippi
and Louisiana were hit hard
The United States Government Accountability Office released a statement on
December 2, 2009 by Kay E. Brown, Director Education, Workforce, and Income
Security given to the Hoc Subcommittee on Disaster Recovery, Committee on
Homeland Security and Governmental Affairs: July 2009 report entitled Disaster
Assistance: Greater Coordination and an Evaluation of Programs’ Outcomes Could
Improve Disaster Case Management GAO-09-561 (Washington, D.C.: July 8, 2009).
This report has information about failures in the case management system. In a
July 2009 report, GAO recommended that FEMA conduct an outcome evaluation of the
disaster case management pilot programs. FEMA said it does not plan to conduct
its own outcome evaluation, but will determine lessons learned and best
practices from third party evaluations of ongoing pilot programs submitted by
each of the agencies administering a pilot program. According to a FEMA
official, each of the third party evaluations will examine program outcomes. So
here is FEMA still not understanding the need for an evaluation of their work
other than by their subcontractors, the third parties – the nonprofits.

How should the nonprofits in this story have handled this case from the
beginning?
This is the story from Third Sector Online of vindication for Lettie Fortune who
fought for 18 months for an apology for being dismissed inappropriately as a
volunteer advice worker for the Lincoln and District Citizens Advice Bureau
(CAB), U.K. The local CAB service where she volunteered aims to provide the
advice people need for the problems they face; to improve the policies and
practices that affect people’s lives. The Lincoln and District Citizens Advice
service provides free, independent, confidential and impartial advice to
everyone on their rights and responsibilities. It values diversity, promotes
equality and challenges discrimination. Services include but are not limited to
employment, money and financial advice, specialist services such as for people
who speak Eastern European Languages, work with patients with Hodgkinson
disease, providing home visits for residents of the district with disability or
chronic illness and work on social policy changes. It is part of a national
service. Ms. Fortune was fired for allegedly making defamatory comments about
her manager, the bureau manager Roy Trotter. She complained about him in
writing. What caused the sacking of this volunteer, what did she do, what
happened and why did it take so long for vindication? Lettie Fortune went to
Third Sector to tell her story. Third Sector is one of the United Kingdom’s
leading publications for everyone who needs to know what’s going on in the
voluntary and not-for-profit sector. Many of their 80,000 readers are chief
executives, trustees and senior managers in charities, voluntary organisations

Nonprofit Theft – “A Few Bad Apples” or the Invisible Reality?
The nonprofit news the past several weeks has focused on ACORN, a
grassroots community organization around the country. ACORN has been in
the press again concerning alleged fraud and corruption involving
federal funds. Earlier press during the Presidential election in 2008
was about voter registration fraud. Nonprofit organizations and
faith-based houses of worship make the headlines almost weekly about
theft of funds, embezzlement, corruption, fraud, health/safety
violations and misconduct. Nonprofit groups use grant funding for
inappropriate activities. This article will review the latest press
reports about nonprofit crime, several case studies from discovery to
recovery in nonprofits, ideas for preventing and reporting nonprofit
crimes and resources available for nonprofit employers and employees in
confronting crime in a nonprofit. Nonprofit leaders tend to shrug off
such cases as evidence of “just a few bad apples.” But a 2008 report,
trying to identify the scope of such thefts for the first time,
suggests otherwise. The authors put the loss in nonprofits from theft,
embezzlement, corruption and fraud at $40 billion for 2006, or some 13
percent of the roughly $300 billion given to charity that year. Most of
these crimes are not caught through an audit. Add to this the invisible
act of wasting money many people believe we do, and we have a track
record that needs cleaning up.
The nonprofit world has not found a clear
way to minimize theft of
funds, embezzlement, corruption, fraud, health/safety violations and
misconduct. I think it is because we are afraid to. We are a trusting
lot working with trustable people. The governance of nonprofits is not
built to stop crime. “Best practices” may be helpful but they have not
really had an impact. I suggest there are two critical decisions
nonprofit leaders have to make:

Hello,
I live in NYS and am the founder anb ED of a gay, lesbian, transgender
nonprofit organization. Because it took many hours to complete, our
501(c)(3) has just been filed! Last month we paid off our Liability
Insurance. Slowly we`re getting there.
There is one paper that still needs to be filed. I ordered a certified
stamped copy of our EIN papers to add to our 501c3 supporting documents.
I never noticed that on this copy we are advised to immediately file a
Form 1120 by 03/15/2007. OK, so we`re late! We filed our Articles Of
Incorporation in June, 2006 and this was never noticed before. This was
an oversight on my part but are there going to be repercussions as it`s
been over two years?
We are registered in NYS as a not-for-profit w/state with our Tax ID
number but don`t have a NTS Sales Tax Exemption as we were told NOT to
file that until we get our 501c3 in hand. Any thoughts, suggestion or
advice? We`re doing this w/o a lawyer which I hope we`ve done OK so far.

Here is why small and mid-size nonprofits and donors should be wary of the
watchdog Charity Navigator. I am no fan of Charity Navigator. Charity
Navigator is a tax exempt nonprofit organization. It holds itself out as the
number one charity evaluator. Charity Navigator (CN) says of itself that they
are “America's premier independent charity evaluator, (that) works to
advance a more efficient and responsive philanthropic marketplace by evaluating
the financial health of over 5,400 of America's largest charities.” They
measure NPOs basically on previous Form 990s, a troubled, unclear and mistake
prone IRS annual report. Not even CPAs agree what goes into certain
financial parts of the 990 – what are administrative expenses, what are
program
expenses, what are fundraising expenses? Where are the issues of
effectiveness, evaluation, outcomes, impact, results, change, morality,
integrity and
ethics in Charity Navigator's ratings? The new family of 990s may help but
they are still new and will not address all the issues. Here are the
problems with Charity Navigator.
Yes, there is a need for oversight and evaluation of nonprofits
There is a need for oversight of the third sector. Nonprofit organizations
need to be accountable, transparent - their feet held to the fire as to
what they say they are going to do. States’ Attorneys General, the Internal
Revenue Service, independent groups and certain individual funding sources
such as government funding and foundations are insufficient at this time to
do that job.
* But who should be doing this evaluation for the giving public?
* What are the measurement standards?
* Who should be reviewed?
* How can the public trust their support will be used for the
announced purposes?
* How often should they be reviewed?
* How can nonprofits appeal the findings?
* How are international organizations to be reviewed?
* How should advocacy groups be monitored?
These are important issues and there are no easy answers. Charity Navigator
does not address them.

Hi,
How are leaders of small and mid-size nonprofits handling themselves, their
people and fiscal problems? What are you facing as a small to mid-size
nonprofit leader in this economy? Many executive directors and other leaders
of small and mid-size nonprofit organizations are not finding much personal
support for their work and needs resulting from America’s economic
problems.
I read many articles and see training events about how to increase funding
in a bad economy. I read material about how to lay off staff and handle the
human resources of the organization. There is material about finding new
leaders for the future of nonprofits and baby boomers transferring into the
third sector. But what do we see about how you are handling yourself? The
life of a leader or executive director is a lonely job in the best of times.
It does not improve in times of trouble. Here you will find a list and
brief discussion of concerns you may be facing and some hints on handling them.
I am certainly not an expert or the last word in these matters, but the
dialogue should be on the front page for you – and it is not there. This is
my offering to you. Many of us care about what you are facing. Many of us,
including me, have faced this one or more times in our NPO lives.
I believe the bottom line mission for most nonprofits is to comfort the
disturbed and to disturb the comfortable. This is about comforting you, if
you are among the disturbed.
There are three parts:

* Hints to cope with the issues
* Resources
See if any of these issues are real for you. See if the hints give you a
start to handle the issues of leadership in bad times.

Hi,
The Corporation for National and Community Service announced recently the
availability of approximately $8 million in funds to support national
providers of training and technical assistance for community service programs
that use service and volunteering to meet community needs. There will be a
technical assistance conference call on June 9, 2009, information below.
The Corporation will award cooperative agreements in five categories to
organizations with the capacity and demonstrated expertise to deliver
training and technical assistance in one or more of the categories.
Organizations
may include grantees and potential grantees, sub-grantees, sponsoring
organizations and projects, and participants and members in programs
administered by the Corporation including AmeriCorps, VISTA, National Civilian
Community Corps (NCCC), RSVP, Foster Grandparents, Senior Companions, and Learn
and Serve America and in support of other special initiatives of the
Corporation.
The 5 categories are:
1. Technology/Knowledge Management including Specialized Service Learning
Services (Approximately $2.5 million for year one, including at least
$750,000 for specialized service-learning services);
2. Training Support (Approximately $3.5 million for year one);
3. Training and Technical Assistance to AmeriCorps State*National Programs

Nonprofits, National Service and Volunteers
The President and Congress are making a number of Federal programs
available to nonprofit organizations for national service and volunteers. There
are three Federal funding streams for national service and nonprofit
organizations:
(1) American Recovery and Reinvestment Act of 2009 (ARRA) and the
Corporation for National and Community Service,
(2) the Edward M. Kennedy Serve America Act and the
(3) 2010 Federal Budget.
None of them are currently available for applications. This is a great
opportunity for you to assess all three programs, see how they match your

Hi,
The Administration for Children and Families (ACF), Office of Community
Services (OCS) solicits applications for grant awards for the Community
Services Block Grant Program to fund up to 48 Statewide capacity-building
collaborations.
This is one for nonprofit leaders to read, understand and collaborate
ASAP. It is partly in preparation for CSBG funding covered by the American
Recovery and Reinvestment Act of 2009 (ARRA)
Here is what the grant announcement says in part:
Each Statewide collaboration will include the following two major
component areas:
* Capacity-Building for Ongoing CSBG Programs,
* Strategic Planning and Coordination Supported by the American
Recovery and Reinvestment Act of 2009 (ARRA).
So we know that nonprofits currently funded under CSBG will receive
capacity-building grants. For whom will they be building capacity and for what
purposes?
And we know there will be funds for creating the plan for the ARRA
funding. Who will be in that planning process? Will it include you?
ACF will provide a separate grant award for each project in order to
assure separate tracking of funds and activities. Therefore, a total of 96
grant
awards will be made under this announcement. Estimated total program
funding for Part 1 (Capacity Building for Ongoing CSBG Programs) is $1,200,000
and estimated total program funding for Part 2 (Strategic Planning and
Coordination Supported by ARRA) is $3,840,000. Applicants may apply for up to
$25,000 per 12-month budget period for Part 1.
Applicants also may apply for up to $80,000 per 12-month budget period for
Part 2. Successful applicants will receive a separate award for each
component area. The "Award Ceiling" listing in this notice represents the
ceiling for Part 2 awards, although successful applicants may receive a total of
$105,000 for combined awards under Part 1 and Part 2. For both Part 1 and
Part 2 grantees, funds will be used to provide training and technical
assistance on improving program quality (including financial management),
management information and reporting systems, measurement of program results,
and
responsiveness to identified local needs.
For this specific announcement, OCS has determined that key technical
assistance needs include Statewide efforts designed to
* ensure coordination of Community Action Program Recovery Act
projects,
* inform communities of available services,
* document community results; and
* prepare communities to sustain the impact of Recovery Act funds.
Successful applicants will be subject to reporting requirements consistent
with ARRA and with current CSBG regulations.
This program announcement is intended to support Statewide capacity
development projects for technical assistance in the Community Services Block
Grant program. In addition, the announcement supports Statewide strategic
planning efforts related to the American Recovery and Reinvestment Act of 2009.
Section 674(b)(2)(A) of the CSBG Act, mandates that the Secretary of the
Department of Health and Human Services award a portion of the CSBG
Program's training and technical assistance funds directly to eligible
entities,
and/or Statewide or local organizations or associations with demonstrated
expertise in providing training to individuals and organizations on methods of
effectively addressing the needs of low-income families and communities.
OCS is making funds available to be used for State-level technical
assistance capacity-building within the Community Services Network. These funds
should be used to improve financial management practices, program performance
measurement, information and reporting systems, coordination between
fragmented State and local programs, and ensure responsiveness to locally
identified community needs.
The Recovery Act includes an appropriation of $1 billion for the CSBG
program for Fiscal Years 2009 and 2010. Of this amount, $985 million (98.5% of
the total appropriation) will be allocated in block grants to States, the
District of Columbia, the Commonwealth of Puerto Rico, U.S. Territories, and
to Federal and State-recognized Indian Tribes and Tribal organizations.
States are required to reserve one (1) percent of the funds for benefits
enrollment coordination activities relating to the identification and
enrollment of eligible individuals and families in Federal, State, and local
benefit
programs. All remaining funds allocated to States (99 percent) will be
distributed to eligible community services entities that receive funding
through CSBG.
Remaining CSBG Recovery Act funds ($15 million or 1.5% of the total
appropriation) are reserved at the Federal level for training, technical
assistance, planning, evaluation, investigations, assistance to States in
carrying
out corrective action, monitoring, reporting and data collection, and
development of performance measurement systems. OCS has determined that key
technical assistance challenges under the Recovery Act will include fiscal
management for increased funding, adaptation of data collection systems to
ensure responsiveness to reporting requirements under the Recovery Act, and
Statewide strategic planning focused on ensuring Statewide coordination of
Community Action Program Recovery Act projects.
The Recovery Act projects supported through this announcement are a part
of the Federal government's overall support for training and technical
assistance activities. As specified in the CSBG Act, training and technical
assistance activities may support improved financial management practices,
program performance measurement, information and reporting systems,
coordination between fragmented State and local programs, and ensure
responsiveness to
locally identified community needs. The focus of strategic planning
efforts supported through this grant will be on informing communities of
available services supported under the Recovery Act, documenting community
results,
and preparing communities to sustain the impact of Recovery Act funds
after additional Federal support received through the Recovery Act ends.
Eligible Applicants
* Non-profits with 501(c)(3) IRS status (other than institutions of
higher education)
* Non-profits without 501(c)(3) IRS status (other than institutions
of higher education)
As prescribed by Section 678A(c)(2)of the Community Services Block Grant
Act, eligible applicants are eligible entities (see definitions), or
statewide or local organizations or associations, with demonstrated expertise
in
providing training to individuals and organizations on methods of
effectively addressing the needs of low-income families and communities.
Applicants for funding under this announcement must be recognized by the
State CSBG Lead Agency as a technical assistance provider for eligible
entities within the State and must include a letter of endorsement from the
State CSBG Lead Agency. Requiring a letter of endorsement indicating that the
State recognizes the applicant as a technical assistance provider for
eligible entities and that projects will be conducted in partnership with the
State agency will have the following beneficial effects:
* Assuring that technical assistance activities related to data
collection, reporting, financial documentation, and strategic planning are
conducted in accordance with existing State CSBG Plans and reporting
requirements;
* Facilitating coordination between applicant organizations and State
CSBG Lead Agencies prior to the submission of applications.
Because States do not receive additional funds for administration and
discretionary projects under the Recovery Act, it is particularly important
that CSBG Lead Agencies are consulted in technical assistance activities in
order to maintain the integrity of the CSBG monitoring and coordination
structure.

Community Groups to Receive $1 Billion Boost From Recovery Act
The U.S. Department of Health and Human Services (HHS) announced on April
10, 2009 plans to make $1 billion available for the Community Services Block
Grant (CSBG) program. Funded by the American Recovery and Reinvestment
Act, the new resources will be allocated to states across the country. States
will distribute the new funding to community groups that help Americans
through tough economic times.
"Community organizations across the country are helping millions of
Americans put food on the table and weather tough economic times," said HHS
Spokesperson Jenny Backus. "The Recovery Act will allow these organizations to
help more Americans get back on their feet."
Under the Recovery Act, organizations receiving CSBG funding must use the
resources to help get our economy back on track. Funds must be used to
reduce poverty, revitalize low-income communities, and assist low-income
families become self-sufficient. Eligible entities use funds to provide
services
and activities addressing employment, education, housing, nutrition, and
emergency services to combat the central causes of poverty.

Hi,
Late last week several Federal Departments issued Requests for Proposals
under the banner of the economic Recovery Act. In each there is room for or they
are aimed at nonprofits to be funded for local programs. There are some
lessons learned from this small trickle of RFPs, however.
One RFP was already out with a deadline. The Department has extended the
deadline. They also added this language to the RFP:
"Please check back frequently for additional changes to the solicitation,
including performance measurement and reporting requirements, the Catalog of
Federal Domestic Assistance number, and statutory authorizing language. If you
have completed an application for this solicitation, please do not submit it
without the changes that must be made as a result of the change in funding
source."
Several RFPs have no posted deadline at this time – to be decided at a later
date.

The OMB issued a Memo on February 18, 2009 clarifying the deadlines for all
Federal Departments and agencies to have information about the funding under
the Recovery Act on their web sites. In addition this article will go over
how each web site is to be set up.
Timelines
Federal agencies must:
1. Provide information in funding opportunity announcements and award
notifications on Recovery Act-specific reporting requirements.
2. Within twenty (20) days after enactment (March 9, 2009) of the
Recovery Act, agencies shall post funding opportunity announcements (i.e.,
“sy
nopses’) to Grants.gov. Information about specific requirements (e.g., use of
funds, certification, data reporting, performance measures, etc.) under the
Recovery Act should be in the full funding announcement.
3. The Grants.gov synopsis shall link to the full announcement on the
agency website within thirty (30) days of enactment (March 19, 2009). In the
interim, the synopsis should link to an agency instruction on when the full
announcement is expected to become available.
4. Additional guidance providing further detail and covering a fuller
range of items will be issued within 30-60 days of this memorandum (February
18, 2009).

On January 28, 2009 Forbes Magazine reported that the multi-million National
Heritage Foundation filed for Chapter 11 bankruptcy protection. This action
follows a judgment against NHF from a Texas state jury in Brownsville which
awarded the plaintiff family what now has been calculated as $6.2 million from
NHF.
Forbes reports in part:
“The National Heritage Foundation was founded in the 1960s by J.T. "Dock"
Houk. Its stated mission: "to encourage the undertaking of projects whose aim
is to restore, maintain and extend the national heritage of the United
States." The charity is now run by Houk and his son, J.T. "Tick" Houk. Other
close
relatives are paid employees. [NOTE: for more about the Houk Family’s

The foundation is primarily a donor-advised fund that allows individual
contributors to create mini charitable foundations under its umbrella and
collects fees for its services. But for years, the organization has been
criticized
for being long on donor benefits and tax avoidance and short on charitable
largess."
