With the decision in Writ Petition [civil] no. 4748 of 2007)on 15.04.2010, the
Acting Chief Justice of the Delhi High Court, New Delhi declared that stock
exchanges like National Stock Exchange of India, MCX-SX which deal in money of
Trillions of Rupees, and billions of petty investors are beyond RTI Act, 2005.
They can do any type of activity including Cheating and Breach of Trust (CBT)
but are not answerable to any authority because the Government is funding them.
Is there any RTI activist having knowledge of any judgement of the Supreme Court
of India or any other High Court which has/have declared Stock Exchanges are
under RTI Act, 2005?

The grievance raised in this complaint relate to matters, which are subject of the

I the NHRC Complainant have received a telephonic request from Bony who is the Karnataka Program / Programme Manager of National Association of Street Vendors of India (NASVI) (@ 14:51 hours on Tuesday, April 17, 2012) during which he requested me to give / send / forward a press release that he will/would be sending to me by email. 
 
Bony is a resident of Delhi and not Mysore City. Since he has sent the press release from a Cyber Cafe of Mysore City I had to make the necessary corrections to the original press release in the word document as the press release was very confusing and was very difficult to understand. 
 
After having made the necessary corrections to the original press release and proper formatting (in good faith) I have converted it into a Portable Document Format (PDF).

Responding to the call of National Association of Street Vendors of India (NASVI), more two thousand street vendors of Mysore marched to the Mysore City Corporation office and have given their submission to Municipal Commissioner (MCC) and Deputy Commissioner (DC) on Monday, April 16, 2012 demanding an immediate restoration of their right to livelihood. 
 
It is called by leaders representing 19 different street vendor organisations with NASVI. The MCC has called for a meeting of Street Vendors on Tuesday, April 17, 2012. 
 
Vendors from Mysore City will demand to solve their concerns immediately. 
 
We seek your support to cover the issue and movement to bring public consciousness in support of poor families of vendors lost their occupation for more than 15 days.

"Honour the National Policy and Restore Our (Street Vendors') Rights"
 
16 April 2012, Monday, Mysore:
 
Protesting against the harassment and violation of fundamental rights for livelihood by the Municipal Corporation of Mysore, more than two thousand street vendors of Mysore city marched to the Mysore City Corporation (MCC) Office on Monday, April 16, 2012.
 
Responding to National Association of Street Vendors of India (NASVI), more than 500 street vendors of Mysore city, marched to the MCC Office on Monday, April 16, 2012, demanding immediate restoration of their right to livelihood. Vendors' leaders from Najangudu, T. Narsipura and Hunsur also joined in the Dharna and protest.
 
The agitators said the Karnataka State government and MCC have/had backed up from their promises and have been showing disrespect to the Hon'ble Supreme Court order (The apex court had directed the government to bring in a law for the street vendors by June 30, 2011 so that their fundamental right to livelihood is protected and ensured).
 
In February 2012, Smt./Mrs. Sonia Gandhi, Chairperson of the National Advisory Council (NAC) had also recommended for a Central Law for the street vendors to the Government of India (GoI).
 
In the Budget session the Hon'ble President of India had announced that the Central Government is working on the street vendors' legislation. However, the Government of Karnataka which has/had declared publicly several times promising the State level legislation had not honoured its own words.
 
The Street vendors have submitted a memorandum to Chief Minister and Urban Development Minister of Karnataka on April 07, 2012, and protested before Deputy Commissioner's / DC office on April 12, 2012.
 
On April 10, 2012, street vendors' leaders from Mysore have met and been promised by the Ministry of Ministry of Housing & Urban Poverty Alleviation (MHUPA), Government of India.
 
Vendors have formed a 20 member agitation committee and said that the agitation will/would continue until the MCC respects its words to form a Town Vending Committee, as per the National Policy for the Street Vendors.
 
Responding to the protest the MCC Commissioner and District Collector addressed the crowd and promised a meeting of vendors leaders tomorrow 4 pm (on Tuesday, April 17, 2012) to settle the issue. "The agitation will continue until the concerns are solved" said the leaders to the media.
 
From all of Mysore district 2000 vendors will wait in front of the MCC office to hear the MCC Commissioner after the scheduled meeting at 04:00 PM.

Dear Fellows

 

An order was passed by Mr. R.I. Singh, Chief Information Commissioner Punjab in a Complaint Case  3375 of 2011 decided on 27 February 2012 (see Page 12) announcing therein the existence of an institution of Collegiums consisting of Chief Information Commissioner and two senior most Information Commissioners has been constituted with the approval of the Hon’ble Governor of Punjab. All complaints received against Information Commissioners in Raj Bhawan are forwarded for consideration of collegiums, which gives its view in the matter.  Final decision, however, is taken by his H.E. the Governor of Punjab after considering the matter.

 

This was a major deviation from the standard process of making complaints to the Governor of Punjab against the Information Commissioners under Section 17 of Right to Information Act 2005.

 

By the constitution of this Collegium, State Information Commission Punjab has ensured in one stroke that:

  1. The operation of process of law  (Section 17) has been very cleverly subverted.
  2. The Raj Bhawan has been taken care of.
  3. No complaint against them ever gets to see the light of the day ever.
  4. Their tenure is go scratch less. This is a sarcastic case of “I SCRATCH YOUR BACK – YOU SCRACH MINE” AND WE BOTH ARE HAPPY.

 

A RTI Application dated 14 March 2012 (Pages 08-11). was filed with the PIO of the State Information Commission. The information received is very revealing.

 

  • Commission did a brain storming exercise with Central Information Commission and all the State Information Commissions, before coming out with this sarcastic idea of formation of a collegium. However despite all efforts there had been negligible response and even some of the states replied that there is no mechanism in the Commission regarding action on complaints against the State Information Commissioners  (See File 01 Annexure-B – Letter dated 16.03.2011).
  • In the same vein Commission noted that “Keeping in view of the public interest, the matter was placed before the full commission in the meeting held on 16.02.2011 and it has been resolved (sic to form a collegium). Commission has not elaborated on the Public Interest in this matter.
  • Commission claimed the need arose to set up a collegium as the RTI ACTIVISTS’ FEDERATION PUNJAB is PUSHING complaints against the various Information Commissioners. (Remarks of the SMB - In fact the Collegium dealt with 41 complaints in its 14 sittings and only one complaint of Mr. Balbir Aggarwal has been from the RTI ACTIVISTS’ FEDERATION PUNJAB which was discussed in meetings dated 19.07.2011 of collegium consisting of R.I. Singh CIC, Kulbir Singh, PPS Gill SICs, 08 complaints decided on this meeting).
  • Commission goes at length to explain that the Collegium Set up under section 15(4) of the RTI Act (See reply of PIO at page 13-17).
  • Commission claim that the Collegium is an administrative arrangement and has nothing to do with the judicial function of the commission (as revealed in various meetings of the collegium dealing with the complaints).
  • The collegium dismissed majority of complaints at his own level without refereeing its finding to the HE Governor of Punjab.
  • It is also noticed that the most complainant has not framed their complaints as per provisions of Right to Information Act 2005 and very few were addressed to HE Governor of Punjab. Most complaints were addressed to State Information Commission Punjab, some to Nodal Department.
  • Governor sent all complaints in original to the Nodal Department and very few to the Collegium.
  • At Nodal Department, all complaints found their way to nowhere.

 

The reasons attributed to dismiss the complaints are on the following pages.

 

Please go through the attached files and offer your comments. That will help me file an Appeal under Section 19(1) and a Complaint too. Though, these will land with those very people who engineered this ploy to save them, and no justice is expected from them, yet it is a process to go through and it will ultimately help me during CWP in high court.

How can RTI be misused?  As per the rule, every govt department must put all the public information on the department’s internet website.  If they followed that rule, how can the public “misuse†RTI?  The public will just go to the dept website and get the information they want.

Long back in 2007 itself freinds in Karnataka gave a thought and a call to all
Crusaders /Activists/users/beneficiaries of RTI that they should have one common
agenda of Ensuring that all PAs should Publish the Suomoto declarations
Extensively and in Full without any Concealment .I am Proud to Note that Scores
of Like Minded Persons in all the Above Cited Categories Heeded to our Word and
As Result One Group Now can Do some Analysis . How Foar it is on Par with the
"AUDIT of Proactive Disclosure" as Envisaged by the Nodal Agencies is a
Verydifferent Issue .
However even the Hon'ble Supreme Court in the Answer sheet Case also Gave
Extensive Directions on the Proactive Declaration .
It is very arguably the Heart of the RTI ACT and Except in a very Few instances
the Inclination and Mindset of ALL INDIA SERVICE OFFICERS to Reveal all , not be
Opaquae and be Fully transparent .
I Commend Mr Kalidas Reddy An Young Man of his Thought Provoking Mail and

Recently, a RTI Applicant who filed 2 RTI Applications with the Assistant Registrar of Cooperative Societies at Ajnala District Amritsar was threatened of dire consequences if he dies not withdraw his RTI Application. The people who threatening includes the Inspector working in the office of Assistant Registrar of Cooperative Societies at Ajnala and other goons of the Secretary of the Jasraur Cooperative Agriculture Service Society (JASS), of which the RTI Applicant is a member.

 

The applicant used RTI route to bring about the transparency in the working of JASS and to stop the mal practices going on in over there. In and SOS Compliant to the Chief Information Commission Punjab has pleaded for the protection from the threateners. The copies of the letters written to the Chief Information Commission have also been endorsed to Punjab Human Rights Commission, Sector 34, Chandigarh.

Registrar, Co-operative Societies, Punjab, Chandigarh, Hon’ble Deputy Commissioner, Amritsar, Hon’ble SSP (Rural) Amritsar, SHO, Police Station Bhindia Saidan, Tel: Ajnala, Distt. This latest threat is a series of threats received by the RTI Information seekers and many had resulted fatal, as the authorities failed to take timely action in time. Copy of the letter written to various authorities is attached.

 

a division Bench of the High Court comprising Justices M.M. Kumar and R.N. Raina in recent past  (on 08 December 2011) asked the States of Punjab, Haryana and the UT Chandigarh to review their Whistle-Blower Protection Policies and consider associating civilians also in the process of assessment of threat perception to the Whistle Blowers, including RTI Activists. Division Bench had observed that “We are of the considered view that the policies of Punjab, Haryana as well as UT Chandigarh are required to be made broad-based. The concerned committees are not only required to have in it Police officers or other officers, there is necessity to associate either Members of the Bar or other private persons like District Attorneys/ Advocate Generals, depending upon the level of the concerned Committees.”

 

In another case the High Court bench, taking the matter very seriously, ordered”the Bench noticed that Arora has filed several cases in the High Court thereby bringing the illegal activities of various persons to the notice of the High Court, and in view of what he has stated in para no. 3 of his application also, he faces a real threat perception.  The Bench also took note of petitioner’s submission that he requires security of Chandigarh Police only on 3 or 4 occasions in a year, when he may be required to visit Punjab. The Bench also recorded the assurance of the Senior Standing Counsel for UT Chandigarh administration to do the needful, and directed that whenever petitioner has to visit Punjab, he would communicate it to the SSP, Chandigarh, who would provide requisite security to him for visiting Punjab.”

 

This matter is gathering dust in the air-conditioned secure rooms of the bureaucrats.

Dear Veteran,
I asked for complete details of information regarding the Police Investigation into the three time burglary/theft/trespass into my housein 2009 August.
Police wrote some cock and bull story and never attached any photocopy of document as requested in my RTI application.
As SPIO and FAA failed I lodged complaint with WBIC on 7th June 2010 which was lying with them till Fen 2012.
I made a WP in Kolkata HC seeking reason for unsatisfactory reply, proof of ducument and penalty for delay from SPIO and seeking reason for delay from WBIC. I also asked for Cost of Legal process incurred by me due to the lapse of SPIO/FAA?WBIC.
The HC passed a partial judgement asking WBIC to redress the grievance within 45 days.
A 'formal' hearing happened in March 28th, the order of which reached me on 26/04/2012, which only stated that the SPIO is instructed to give a proper reply.
It avoided inspection of document stating that these are 'court document' . Non attachment of document was also smoothly missed out. Even the penalty for not giving required information, harassment caused by wilful delay and false/untrue statement/reply did not took plae in the order atall.
SHOULD I GO TO THE HIGHCOURT under the same WP stating that I am not satisfied with the ORDER or the ORDER is a Partial one.
IF the HC does not conduct the DELIVERY OF JUSTICE 'in a JUST AND EQUITABLE way what option is left to me.
Who is liable for WBIC not following the RTI Act in full spirit of transparency and not imposing fine on erring official.
Who is liable for the HC giving additional 45 days where the details required by me were already 2 years past and
the HC did not penalise WBIC for the partiality caused by WBIC, meaning that the WBIC had already conducted hearing for those complaint cases filed after me and ignored mine.
I donot have much money spend on court matters again and again for the lapses of the State.

In another case the High Court bench, taking the matter very seriously, orderedâ€the Bench noticed that Arora has filed several cases in the High Court thereby bringing the illegal activities of various persons to the notice of the High Court, and in view of what he has stated in para no. 3 of his application also, he faces a real threat perception.  The Bench also took note of petitioner’s submission that he requires security of Chandigarh Police only on 3 or 4 occasions in a year, when he may be required to visit Punjab. The Bench also recorded the assurance of the Senior Standing Counsel for UT Chandigarh administration to do the needful, and directed that whenever petitioner has to visit Punjab, he would communicate it to the SSP, Chandigarh, who would provide requisite security to him for visiting Punjab.â€
 
This matter is gathering dust in the air-conditioned secure rooms of the bureaucrats.

PUNJAB STATE INFORMATION COMMISSION FLOUTS ITS OWN REGULATIONS

 

State Information Commission, Punjab does not bother to follow the information disseminated on its website
As per manual iii of the section 4(1)(b) available on its website, "The Commission receives appeals against the orders of appellate authorities under section 19 of the RTI Act. These are placed before the CIC. The appeals are decided after giving opportunity of hearing to both the parties. It is pertinent to mention here that the cases are considered as disposed of only after confirmation of compliance of the orders of the Commission.” But in practice the Commission does not bother to follow what it says on its website u/s 4(1)(b) of the RTI Act.


In the instant (AC 1134/2011) I had demanded the information regarding the construction of Zone-D building of Ludhiana Municipal Corporation and the Commission, vide order dated 13.12.2011, gave the directions to the respondent PIO (Sh. Dharam Singh, deemed PIO-cum-SE) to bring a copy of FIR registered in connection with the missing file but on the next date of hearing dated 09.02.2012 he had not enclosed a copy of FIR so registered despite issuance of directions given on hearing dated 13.12.2011. Accordingly, PIO-cum-S.E. was once again directed to bring a copy of FIR registered in connection with the missing file on the next date of hearing, i.e. today.


To know the status about the registration of FIR, when the Appellant contacted the Sh. Dharam Singh, deemed PIO over his official mobile no. 97800-39406 yesterday, he told me that police authorities been asking the LMC to name the persons involved in missing file and he has demanded the file of Departmental Inquiry report of Committee headed by Sh. Sh. A.K. Singla S.E.(B&R) which was ordered by First Appellate Authority-cum-Commissioner, LMC in the instant case. Sh. Dharam Singh told the Appellant that he would present before the Commission today and make a request for some more time to lodge the FIR in the instant case.


In the instant case, LMC officials have not lodged the FIR till date against the person responsible for missing file and Sh. B.C. Thakur, SIC disposed of the case without bothering to honour its orders dated 13.12.2011 and 09.02.2012 despite the fact that I had put all the facts before the Commission in shape of written submission duly received in the Commission against dairy no. 6721 and demanding an adjournment by my representative.


This all has been done to save the skin of culprit responsible for missing file and higher officials who had taken the decision to construct the Zone D building on the area of “Green-Belt”.

On 18 November 2011, one of the RTI Activist, wrote to the Chief Information Commission, Punjab about the illegal and ultra-virus RTI Management Regulation of the Punjab Commission as per Delhi high Court Judgement dated 21 May 2010 and demanded its immediate RECALL.

The commission took notice of this demand and after 2 moths, the Full commission met on 18 January 2012 and took up this issue in its 11th meeting. This Item was the only agenda in the meeting and the commission has decided that:

ITEM NO.2: The request dated 18.11.2011 of Sh. Sanjay Kumar Mishra to recall the SIC, Punjab (Management) Regulations 2010. It was decided to have a fresh look at the State Information Commission, Punjab (Management) Regulation, 2010. For this purpose a Sub Committee will be constituted by the Chief Information Commissioner, Punjab. It will look into all aspects and submit its recommendations. 

Nothing transpired after that. 

Both these documents are attached. 

This is a serious matter as commission's management itself is on a explosive regulations and it may even put the entire working of the commission in jeopardy. 

A Commission which is required to instill a rule of order as far as the RTI Regime in Punjab is concerned, is itself is managing itself in an illegal manner. 

It looks that the Commission, mostly consisted of the retired bureaucrats, is still in a bureaucratic hang-over and is refusing to come to terms with the translucency law. 

Commission should sit up and take notice, lest the things explode. 

I am going to file a RTI Application with the Commission to find out what transpires on the issue.

Drunk on power, RWAs are exceeding their brief
At 83—if you live that long, that is—you would naturally look forward to well-earned repose in your twilight years. But M.B. Lal, a former journalist, finds himself battling not just his physical infirmities but also a recurring urban woe these days—the neighbourhood cliques of power-hungry busybodies, otherwise formally known as resident welfare associations (RWAs). In Press Enclave, a south Delhi residential complex that houses many media professionals, including Lal, the RWA had gone to the point of deciding whom he and others could employ as help and even began fingerprinting their entry after a series of thefts. The illegal practice—since only law-enforcing authorities can collect fingerprints—was snipped only in June last year after residents complained to the police.
One can argue that the RWA, rightly concerned about security, may have had its reasons to act vigilante-like, but Lal thinks it is more about keeping the colony under control. “They were paranoid about power, not security, and sought to exercise that power to terrorise members and prevent residents from speaking against them,†he says. Members of the committee at Press Enclave were finally replaced in February this year, but not until their three-year term had ended. “Residents were virtually terrorised. Their tyres would be deflated and their applications for repair work held up without reason,†says Lal.
Meant to better the lives of residents of the colonies they represent, RWAs today can do exactly the opposite with our lives, when misused by individuals intoxicated with the power—and sometimes the money they can bring. Especially when residents like Lal begin to ask uncomfortable questions.

In Bangalore, those questions came from Mallikarjun L.S., a resident of the city’s plush Sadashivnagar. He earned the ire of his RWA when RTI petitions filed by him exposed the association’s practice of charging an entry fee for a neighbourhood park as “illegalâ€. “They collected an average of Rs 45,000 per month. How could they when they had adopted the park from the Bruhat Bengaluru Mahanagara Palike (BBMP) and the play equipment had been installed under the MP’s Local Area Development Scheme,†he says. The Karnataka State Commission for Protection of Child Rights too issued an order asking all children up to 12 to be let in free. “For what I did, they tried to have me evicted from my ancestral property in the locality and had criminal charges filed against me,†he adds. But Jagadish G., the secretary of the RWA, told Outlook they were not alone in making children pay. “Even the BBMP runs two parks nearby and they charge a fee for entry there,†he says. “And after the park was handed back to the BBMP end of last year and entry made free, you have all kinds of people coming in and doing all kinds of nonsense.â€

Any interference with parks, often the only open spaces in our cities, is reason enough for RWAs to bare their fangs. Ruling against the Rajinder Nagar RWA in New Delhi, which had opposed the segregation of its park to be developed as a playground, Delhi High Court judge Justice Rajiv Sahai Endlaw in April last year termed RWAs no less than “selfish giantsâ€. The same year, there was also the case of Richha Sharma, a social entrepreneur who runs Sunaay Foundation, who bore the brunt of the RWA in B-1 block in Vasant Kunj in Delhi. Her fault? Running a temporary school for less privileged children in one of the colony parks, something that violated the “decorum of the societyâ€.
Essentially a middle-class phenomenon, RWAs are besotted with the idea of creating illusory islands of middle-class prosperity that are divorced from larger realities. Several RWAs in Delhi and Mumbai are locked in conflict, often in court, with vendors who have been using public spaces in and around their colonies for years, some even before the latter were built. Harassed now for the mess they create, sections of roads they used to hawk on are metamorphosing into parking lots. Similarly, Lal has failed, despite being a member now, to convince his RWA, which has an annual budget of Rs 40 lakh, to pay its workers even the minimum wage (Rs 7,020 per month in Delhi).
RWAs can also enforce ghettoisation in the guise of enhancing security. In March this year, the Federation of Velachery Welfare Association (East) in Chennai asked its members not to rent out flats to bachelors, especially those from north India, leaving many harassed. This followed reported encounter killings where people from the north were shot dead by the police. “The public also has a responsibility in ensuring security,†says S. Kumara Raja, the association’s secretary. “We’re not against north Indians and it is just an advice, not a forceful order.†Communal segregation has long been the gift of RWAs. And no one knows this better than Delhi-based photojournalist Mustafa Quraishi, who blames their tyranny for the “worst three months of his life†in 2005 in Mumbai when he had to change guesthouses frequently, even live out of a car, after being refused flats on rent because of his religion. “Most would say that we are not communal, but the RWA has decided to keep the society this way,†he says. To his credit, he never mentioned that he is the son of the present chief election commissioner S.Y. Quraishi.
The April 15 municipal elections in Delhi too brought the focus back on RWAs. A few south Delhi RWAs, together with an anti-corruption NGO, had candidates attend a meet and sign a list of development tasks they had to carry out if elected. Says Shailender Singh Monty, one of the councillors present at the meet, “Some RWAs wanted to dictate terms. Does a signature guarantee execution? There were so many candidates who signed papers without reading them.†One of the many “unreasonable†demands he refused to agree to was the creation of three underground parking lots in 100 days. “Instead of being the interface between residents and politicians, RWAs want to exercise more than their fair share of authority. And most seek to join them not to serve residents but to become politicians.†RWAs have therefore become increasingly divisive and political as parties lust after their capability to mobilise people and as aspirants think of terms at these associations as springboards to bigger political profiles.
An example of this transformation being Sanjay Kaul, who, thanks to his role as chairperson of the United Resident’s Joint Action (URJA), went on to become the BJP’s Delhi spokesperson. And he, having used the might of RWAs to campaign against hikes in electricity tariffs, defends their actions. “The civil society gets castigated for not being interested in civic issues. Dear Fellow members,

My name is Anshu Bansal and I am a member of RTI-USA chapter. Currently, I am visiting India on family emergency and returning back on May 16th. On my visit, I learned that my family in India is in little stressed (they didn't tell me this so far) since my youngest brother who is studying in BTech in Engineering in Dehradoon area has been framed in some wrongdoings by Dehradoon, police.

His name was intentionally added with real culprit. My brother's career is on stack since in return the Victim (who filed FIR) is blackmailing us and asking lots of money which we can't afford. if you guys will hear about the case, you guys would mock.

The case is about mobile theft and they (victim) is asking INR 5 Lacs to cut the FIR which is no way possible and not  reasonable. Lots of good faith efforts has been established with the guy but didn't come out with any conclusion since victim knows that I live in US and our family can do anything to get this matter settled and pay them. This kind of money just for mobile theft is not possible for us and not justified. All this is happening because victim's family has some IAS approach in Dehradoon area. Thanks to all corrupted bureaucracy system in India which is very unfortunate.

Request from my fellow members:
If my fellow member could suggest what are the options we have here, would be great. I am hoping to get some traction on this matter before my return.

alternatively, if someone could help us in Dehradoon area, would be really appreciated. We dont know any police man or any IAS.

Dear Friends, I had the privilege to serve on a Western Ghats Ecology Expert Panel constituted by the Ministry of Environment and Forests, GoI. Our principal mandate was to:

(i) To assess the current status of ecology of the Western Ghats region.

(ii) To demarcate areas within the Western Ghats Region which need to be notified as ecologically sensitive and to recommend for notification of such areas as ecologically sensitive zones under the Environment (Protection) Act, 1986.  

(iii) To make recommendations for the conservation, protection and rejuvenation of the Western Ghats Region following a comprehensive consultation process involving people and Governments of all the concerned States.


With great sincerity we did our job. Basically this was a scientific task of deciding on a set of criteria for declaration of Ecologically Sensitive Zones on the Western Ghats, putting together a spatial database on ecological parameters for the Western Ghats, delineating potential ecologically sensitive zones, and suggesting a strategy for conservation, protection and rejuvenation of the Western Ghats Region, in view of our delineation of ecological sensitivity.
We conducted very wide ranging consultations with civil society, all state governments, MoEF officials, elected representatives ranging from Gram Panchayat members to MPs and Ministers and CMs.
We published a scientific paper based on the initial formulation of criteria for public discussion in India's premier scientific fortnightly, Current Science in January 2011.
We submitted our report as required on August 30, 2011. We were told that it will be released at a public function on 21 September 2011. On 19 September 2011 we were informed that the report is not going to be made public for the present, and that we should not release it or discuss it publicly.
Beyond that, our report has obviously set in motion a fascinating series of developments.
On April 9, 2012 Central Information Commissioner passed an important order, and I quote from it:

If such reports are put in public domain, citizens’ views and concerns can be articulated in a scientific and reasonable manner. If the Government has reasons to ignore the reports, these should logically be put before people. Otherwise, citizens would believe that the Government’s decisions are arbitrary or corrupt. Such a trust deficit would never be in the interest of the Nation.

The disclosure of the WGEEP report would enable citizens to voice their opinions with the information made available in the said report. Such opinions will be based on the credible information provided by an expert panel constituted by the government. This would facilitate an informed discussion between citizens based on a report prepared with their/public money.

MOEF’s unwillingness to be transparent is likely to give citizens an impression that most decisions are taken in furtherance of corruption resulting in a serious trust deficit. This hampers the health of our democracy and the correct method to alter this perception is to become transparent. Such a move would only bring greater trust in the government and its functionaries, and hurt only the corrupt.

CIC had ordered the report to be made public by 10th May. Additionally he ordered that MoEF must put all such reports in public domain within 30 day's of receipt, in accordance with requirement of suo moto disclosure in RTI
Now I understand that MoEF has gone to Delhi High Court against this order.
The full CIC order is an outstanding piece of argument on environment- development issues and on people's role in decision making. It deserves to reach people everywhere. So I have translated in Marathi with a brief introductory background note, and this article will appear next week in Marathi weekly, Sadhana.
I write this to urge you to consider similarly translating the CIC order in other Indian languages and have it published in appropriate media.
The CIC order and my Marathi translation are attached for your information.

Hi Anshu : 

Once FIR is registered, the Complainant does not have control  "to cut the FIR". After completing the Investigation the Police is duty bound to file Investigation Report before the concerned court. In case in course of investigation they find that your brother had no role they would not file chargesheet against him. In case they do then after chargesheet and before framing of charge your brother could go for discharge. Even at this stage your brother could go before the concerned High Court and make an Application for quashing of FIR under Sec 482 of Crpc. If discharge fails then your brother would have to face trial and get acquitted. 

These are the options available. Which one is possible depends on the merit of the case for which one needs to study the papers. Do consult a lawyer with the papers.
